al.s dict.s John Magan of said County Gent was Sumoned to answer
          to answer unto James Shirley of a plea that he render unto him four pounds ten shillings which
       to him he Owes and unjustly detains &.c

                     And whereupon the said James by Levin Gale his attorney saith that whereas the said
John the Eighth day of December anno Dom One thousand seven hundred and twenty Eight at Somersett
County afd within the Jurisdiction of this Court by his Certain bill Obligatory which the said James
with the Seal of the said Jn.o Signed hereinto Co.t Brings ye Date Whereof is the Same Day & year
Did bind himselfe his heirs Ex.rs & adm.rs to pay or Cause to be paid unto ye Said James ye afd
four pounds ten Shill.s Yett ye afd Jno the Said four pounds ten Shills to ye said
James tho' often by the Said James thereunto required hath not paid but the same to
him hitherto to pay hath refused & Still Doth refuse & Deny to ye Dam of ye said
James of Nine pounds Curr.t Mony of Maryland & thereupon he brings Suite &c
                                                             Levin Gale P Quer pledges &c  J Doe R Roe

          And the afd John Magan in his own proper person Comes & Defends ye force
    & Injury when &.c  And pray's Leave to Imparle hereunto untill the Next Co.t & he
hath it & the same Day is Given to the afd Plft here also

                Att which said Next Court to witt the seventeenth day of June anno Dom One thousand
Seven hundred and twenty Nine Came again as well the afd James Shirley by his attorney afd as the
afd John Magan in his own proper person and the said John Magan as before defends the
force and Injury when &.c and saith that he Cannot gainsay the action afd of the afd James nor
but that the writing O Bill of Obligatory afd is his deed nor but that he Owes the Same Day
the afd four pounds ten shillings in manner and form as the afd James ^above^ against him declared
wherefore the said James prays Judgmt for his debt afd and his Costs and Damages Sustained
by Occasion of the detaining of the Same debt to him to be adjudged &.c

                Therefore it is Considered that the afd James Shirley Recover against the afd
John Magan his debt aforesaid and his damages Sustained by Occasion of the detaining
253   of the same debt to Two hundred & fifty three                  pounds of tobo to the same
James by the Court here of his assent adjudged with stay of Execution till the tenth ^day^ of Novem
Next and ye afd deft in mercy &c
