against him alledged and of this he putts himselfe upon the Country and the afd Plft in like manner

            Thereupon Command is given to the Sher of Somersett County that Immediately he Cause to
Come here twelve &.c by whom &.c who neither &.c to Recognize &.c because as well &.c of which said preceipt
the said Sher to witt John Purnall Gent now hereat this day to witt the same day and year Last mentioned
makes return that he hath here ready twelve &.c as by his said preceipt he was Commanded and
now here afterwards to wit the Same day and Year Came againe as well the afd Plft as the afd
defend.t by their attorneys afd and the Jurors of that Jury therein Impannelled being Called Likewise
Came to witt William Handy, John Pope John Townsend, Christopher Piper Francis Lanckake,
Thomas Collins, Robert Collier, Charles Townsend, Cord Hazzard Jos Gray Ceaser Goddin and
Thomas Holbrook who being duely Elected tryed and sworn ^to say the truth in the premisses^ upon their Oath do say that the Said
Job Sherry is not Guilty of Speaking publishing and pronounceing of the Scandelous words of
the afd Stephen as he above against him hath Complained &c

                      Therefore it is Considered that the afd Stephen Odear Jun.r take nothing by his writt &
declaration afd but be in mercy for his falce Clamour and that the afd Job Sherry goe thereof without
day &.c  Also it is Considered by the Justices here that the afd Job Sherry Recover against the afd Stephen
750   Odear Jun.r Seven hundred & fifty                            pounds of tobacco for his Costs and Charges by
him about his defence in that part apposed to the Same Job by discretion of the Justices here adjudged
according to the form of the Statute in such Case Lately made and provided &c

                       Hannah Horsey and John Horsey both late of
somersett County planters was attached to answer unto Joseph MccClester
of a plea of trespass upon the Case &c
       And whereupon the Same Joseph by Levin Gale his attorney Complains that whereas the afd
Hannah & John the tenth Day of May Anno Dom One thousand Seven Hundred
& twenty Eight at Somrsett Co.ty within ye Jur of this Court was Indebted
unto the Same Jos: in the Sum of Eighteen Hundred & forty two pounds of
Tob.o as by Acc.t herewithin Court Produced may appear  And so thereof being
Indebted the Said Hannah and John in Consideration thereof afterwards to witt
the Same Day & year afd at ye County afd & within ye afd Jur upon themselves
assumed & to the Same Joseph then & there faithfully Promised that when
afterwards they shou'd be thereto requested they ye afd Sum of Eighteen Hundred
& forty two pd.s of tob.o to ye Same Jos wou'd well & faithfully Content & pay Nevertheless
ye Said Hannah & John their promise & assumption afd in form afd made not
regarding but Plotting and fraudulently Intending him ye Same Jos in yt part Craftilly & Subtilly
to Defraud & Deceive ye afd Sum of Eighteen Hundred & forty two pd.s of tob.o or
Any part thereof to ye Same Jos: they have not paid although the Same to Doe
the afd Hannah & John afterwards viz.t the Same Day & Year afd at the Co.ty afd
& within the Jur afd by the Same Joseph Were requested but they the Same
hitherto to Doe have altogether refused & Still Doth refuse Whereby the
