1729 194 Job being not Ignorant of ye prmisses but Malitiously plotting & Contriving him ye said Stephen in his Good Name fame Creditt & repute afd to hurt Detract & Make worse & him ye said Stephen into Scandall & Infamy Amongst his Neighbours & Others to bring & also to Cause him Innocently to be Brought in Danger of paying four fold & being Whipt & pillored as ye Law in Such Cases Directs ye thirtieth Day of Janry Ann.o Dom One thousand seven Hundred & twenty Eight at ye Co.ty of Somrsett afd within ye Jur of this Co.t having Communication & Speech with Sundry faithfull Subjects of our Lord ye King Concerning Making search for Pork which he ye Said Job then & there asserted to be Stolen from him falsely & Malitiously Did assert & Speak these falce Malitious & Infamous words Following in their prsents & hearing of him the Said Stephen viz.t I himselfe ye said Job Meaning may Search where I please but no Body but Jn.o Odear & his Brother Stephen (Meaning him ye Said Stephen Odear) have Gott my Pork & also ye Day and Year afd at ye place afd after Search Made these Other false Infamous Malitious Words Following Malitiously of him ye said Stephen did Further Pronounce and Speak in the Presence & hearing of Said Sundry faithfull Leige Subjects of our Lord ye King haveing Speach & Communication Concering the Stolen pork as alledged & the said Stephen (Had I himselfe ye said Job Meaning Known how to have Searched ye Branch (Meaning the Said Branch by ye Said Stephens Plantation) may be I should have found it (the Stolen pork afd Meaning) When as in truth ye said Stephen no Such Wicked & base Crime Ever Committed or perpetrated by pretext of ye Speaking of which false Infamous Malitious & Scandelous words ye Said Stephen not only in his Good Name fame Creditt Estimation & repute afd is Very Much Hurt but also Sundry Sums of tob.o for vindicating his Innocency in this part is forced to Expend Whereupon he Saith he is worse & hath Dam to ye value of fifty pounds Curr.t Mony of Maryland & thereupon he brings Suite &a And ye said Stephen will verifie that ye Words afd are of ye Same purport & are so understood amongst his Neigbours as if he had said Jn.o Odear & Stephen Odear have Stole my Pork &.a Fran: Allen P Quer Pledges &.a D Doe R Roe And the afd Job Sherry by Levin Gale his attry Comes & Defends the force & Injury when &.a And prays Leave to Imparle hereunto untill ye Next Court & he hath it & ye Same Day is given to ye afd Plft here also Att which Said Next Court to witt the Eighteenth day of March ann.o Dom one thousand seven hundred and twenty Eight Came again as well the afd Stephen Odear as the afd Job Sherry by their attorneys afd and the said Job by his said attorney prays further Leave to Imparle hereunto untill the next Court and he hath it and the Same day is given to the afd plft here also &c Att which said next Court to witt the seventeenth day of June anno Dom One thousand seven hundred and twenty Nine Came again as well the afd Stephen Odear as the afd Job Sherry by their attorneys afd and the said Job by his said attorney as before defends the force and Injury when &.c and saith that he is not Guilty of the premisses above upon Imposed in manner and form as the afd Stephen above against |
