193 afd Ought not to have According to the form of the Recovery afd if to him it shall Seem Expedient & have you there the Names of them by whom to him you Make ye Same Known & this Writt Wittness Sam.l Hopkins Gent Chief Justice of our Said Co.t this twenty third Day of August in ye thirteenth Year of our Dominion &.a Anno Dom one thousand Seven Hundred and twenty Eight Att which said third tuesday of November to witt the Ninteenth day of the Same month One thousand Seven hundred and twenty Eight Cometh the afd Joseph MccClester by his attorney afd and the Sher of Somersett County to witt John Purnall Gent Returned that by vertue ^of the writt^ afd to him thereof directed he had made known unto the afd John Bishop that he be before the Justices of his Lordships County Court of Somersett at the time and place afd &.c to make and receive &.c as the Same writt in its Exigence is required by Thomas Claywell and George Jones Good and Lawfull me of this Bailywick &.c And the same John Bishop accoring according to the forewarning to him in that part given by francis Allen his attorney Comes and prays Leave to Imparle hereunto untill the Next Court and he hath it and the same day is Given to the afd Plft here also &c Att which said Next Court to witt the Eighteenth day of march anno Dom One thousand Seven hundred and Eighteen Came again as well the afd Joseph MccClester by his attorney afd as the afd John Bishop by his attorney afd and hereupon the said John Bishop by his said attorney prays furthe Leave to Imparle hereunto untill the next Court And he hath it and the Same day is Given to the afd Plft here also Att which said next Court to witt the Seventeenth day of June anno Dom one thousand seven hundred and twenty Nine Came againe the Said Joseph MccClester by his attorney afd and Prays Execution of the damages aforesaid against the afd John BIshop and the said John says nothing in bar or retardation of the Execution afd by which the Same Plft remains against the afd deft thereof undefended Therefore it is Considered that the afd Joseph MccClester have Execution against the afd John Bishop of the Damages afd &.c And that the afd Joseph Macclester according to the form of the Statute in Such Case Lately made and provided Recover against the afd John Bishop Two hundred & Twenty 123 three Pounds of tobacco for his Costs Charges and damages sustained by occasion of delay of Execution of the damages afd by pretext of the writt afd by Consent of the afd Joseph taxed &c
Stephen is a good true honest & faithfull Leige Subject of our Lord ye King yt now is & as Such from ye time of his Nativity hitherto hath Demeaned & behaved himselfe & of Good Name fame Creditt Estimation & repute amongst his Neighbours & Other faithfull Leige Subjects of our Lord ye King & his Predecessors Kings of ye realm of Great Brittain to whom he was Known by the Whole time afd was Deemed held & reputed and without any Kind of Felony Larceny or any Other Hurtfull Crime or Blott both hath hitherto free Clear unsuspected & unattainted remained Nevertheless the said (Job) |
