193 Come here twelve &.c by whom &.c who neither &.c to Recognize &.c because as well &.c of which said preceipt the said Sherr to witt John Purnall Gent Now hereat this day to witt the Same day and Year Last mentioned makes Return that he hath here Ready twelve &.c as by his Said preceipt he was Commanded and now here afterwards to witt the Same day and Year Came as well the aforesaid plft as the afd deft by their attorneys aforesaid and the Jurors of that Jury therein Impannelled being Called Likewise Came to witt William Handy, John Pope, John Townsend, Christopher Piper, Francis Lankake Thomas Collins Aaron Linn, Charles Townsend, Cord Hazzard Joseph Gray, Ceaser Goddin, Thomas Hoolbrook who being duely Elected tryed and Sworn to say the truth in the premisses upon their oath do say that the afd William West did assume upon himselfe in manner and form as the afd Thomas Dashiell above against him hath Complained and do assess the damage of the Same Thomas Dashiell by occasion of the non performance of the promise and assumption afd beyound his Costs and Charges by him about his Suit in that part apposed to five hundred and fifty eight pounds of tobacco and for those Costs and Charges to One pound of tobacco Therefore it is Considered that the afd Thomas Dashiell Recover against the afd W.m West his damages afd ^by the Jurors aforesaid^ in form afd assessed as also six hundred and Eighty One pounds of tobacco for his Costs and Charges afd to the same Thomas Dashiell by the Court here of his assent of Increase adjudged which Certain Damages in the whole do amount to twelve hundred and forty pounds of tobacco and ye aforesaid deft in mercy &c
and avalon Lord Baron of Baltemore &c To the sher of Somersett County Greeting whereas Joseph MaClester Lately in our Co.ty Co.t of Somrsett here to witt ye fifteenth day of March One thousand Seven Hundred & twenty five before Sam.l Hopkins Gent.m & his associates then Justices of our Said Co.t at Dividing Creek & by Consideration of the Same Co.t recovered against John Bishop Late of Somrsett Co.ty Planter Eight Hundred & thirty two pounds of tob.o for his Dam.s which he sustained by Occasion of a Certain Promise & assumption to the Same Jos: by ye afd Jn.o Lately Made & not Performed Whereof he is Convict as by the record & Process thereof in our Same Court before our Justices at Dividing Creek remaining Manifestly appeareth Nevertheless Execution of ye Judgm.t afd as yett remaineth to be Made as by the Insinuation of ye afd Jos: we have received & because we are Willing that those things which in our Same Court are rightfully Done Should be Duly Executed Command you that by Honest & Lawfull Men of Your Balywick you Make Known unto the afd Jn.o Bishop that he be before Our Justices of our Co.ty Co.t of Somrsett to be Held at Dividing Creek ye third tuesday of Novem.r Next to Shew Cause if any for himselfe he hath or Knoweth to say Wherefore the afd Jos: MaClester Execution against him of ye Judgm.t (afd) |
