thereto requested he the afd Sum of Seven Hundred & Sixty four pounds ^of tobacco^ to ye
Same Tho.s wou'd well & faithfully Content & pay Nevertheless ye Said Will.m his
promise & assumption afd in form afd Made Not regarding but Plotting & fraudulently
Intending him the Same Tho.s in that part Craftilly & Subtilly to Defraud
& Deceive ye afd Will.m ye afd Sum of Seven Hundred & Sixty four pd.s tob.o or
any part thereof to the Same Tho.s he hath not paid or him for it in any wise
Contented Although ye same to Doe ye afd Will.m afterwards viz.t ye same Day and
year afd at ye Co.ty afd & within ye afd Jur by the Same Tho.s was requested
but he ye Same hitherto to Doe hath altogether refused & still doth refuse
whereby ye Same Tho.s Say's he is worse & hath Dam.s to ye value of fifteen hundred
pd.s of tob.o & thereof he brings this Suite &a

June the 19.th Day Ann.o 1729 then personally appeared here in open Court before
M.r Sam.l Hopkins & his associates Justices of the same Co.t Judicially Sitting
M.r Tho.s Dashiell & made Oath on the Holy Evangelist of Almighty God that the
above Acc.t is Just & true (Except one Hundred & fifty p.ds of tob.o) & that he hath received
no part or percell thereof Save Creditt Creditt Given                                 Tho.s Hayward Cl

    And the afd Will.m West by Francis Allen his attry Comes & Defends the force & Injury
when &.c  And prays Leave to Imparle hereunto untill the Next Court & he hath it & the
Same Day is given to the afd Plft here also &a

          Att which said Next Court to witt ye Eighteenth Day of March Anno Dom one thousand
Seven Hundred & twenty Eight Came again as well the afd Thomas Dashiell as the
afd William West by their attrys afd  And the said Will.m West by his Said attry prays further
Leave to Imparle hereunto untill the Next Court & he hath it & the Same Day is
Given to the afd Plft here also &a

             Att which said Next Court to witt the seventeenth day of June anno Dom One thousand Seven
hundred and twenty Nine Came again as well the afd Thomas Dashiell as the afd William West by their attorneys
afd and the said William West by his said attorney as before defends the force and Injury when &c and saith
that he did not assume upon himselfe in manner and form as the afd Thomas above against him hath
Complained and of this he puts himselfe upon the Country &.c   And the plft in like manner

            Thereupon Command is given to the sher of Somersett County that Immediately he Cause to
