192 Att which said third tuesday of August to witt the twentieth day of the Same month Anno Dom one thousand seven hundred and twenty Eight Cometh the said John Donelson by his attorney afd and the Sher ^of Somersett County^ to witt francis Allen Gentleman Returned that by Vertue of a writt of his Lordships to him thereof directed he had made known to the afd Robert Collier that he be before his Lordships Justices of the County Court of Somersett at the time and place afd &.c to make and receive &.c as the Same writt in its Exigents is required by Francis Porter and John Doe Good and Lawfull men of his bailywick he was Commanded &.c which Certain Robert Collier according to the fore warning to him in that part made by George Dashiell his attorney Comes and prays Leave to Imparle hereunto ^untill ye next Court^ and he hath it and the same day is Given to the afd Plft here also &.c Att which said next Court to witt the ninteenth day of November one thousand Seven hundred & twenty Eight Came again as well the afd John Donelson as the afd Robert Collier adm.r as afd by their attorneys afd and the said Robert Collier by his said attorney prays further Leave to Imparle hereunto untill the next Court and he hath it and the same day is given to the Plft here also Att which said next Court to witt the ninteenth day of November one thousand seven hundred & twenty Eight Came again as well the afd John Donelson as the afd Robert Collier adm.r as afd by their attorneys afd and the said Robert Collier by his said attorney prays further Leave to Imparle hereunto untill the next Court and he hath it and the same day is given to the Plft here also Att which said next Court to witt the Eighteenth day of March one thousand seven hundred and twenty Eight Came againe as well the afd John Donelson as the afd Robert Collier by their attorneys afd and thereupon the said Robert Collier adm.r of the said Roger Nicholson by his said attorney and prays further Leave to Imparle hereunto untill the next Court and he hath it and the same day is Given to plft here also &.c Att which said next Court to witt the seventh day of June anno Dom one thousand seven hundred and Twenty Nine Came againe as well the afd John Donnelson as the afd Robert Collier by ther their attorneys afd and thereupon the afd John Donelson by his said attorney Confesseth that he will no further prosecute his writt afd against the afd Robert Collier in the Premisses afd &c Therefore it is Considered that the afd John Donelson take nothing by his writt afd but be in mercy for his falce Clamour and that the said Robert Collier Adm.r as afd go thereof without day and also it is Considered by the Justices that the afd Robert Collier Recover against the 222 afd John Donelson Two hundred & Twenty Two pounds of tobo for his Costs & Charges by him about his defence in that part sustained according to the form of the Statute in such Case Lately made and provided and that the afd Robert have thereof his Execution &c
Seven Hundred & twenty Seven at Somrsett Co.ty within ye Jur of this Court was Indebted to ye Same Tho.s in the Sum of Seven Hundred & Sixty four pounds of tob.o as by Acc.t herewithin Co.t produced may appear & so thereof being Indebted ye Said Will.m in Consideration thereof afterwards to witt the Same day & year afd at ye Co.ty & within ye afd Jur upon himselfe assumed & to the Same Thomas then & there faithfully Promised that he when afterwards he Shou'd be (thereto) |
