afd Joseph nor Can ^he^ say but that the Writing Obligatory afd is the Deed of the same
Peter nor but that he Owes the Same Jos: the afd Eight Hundred two thousand
three Hundred & thirty pd.s of tob.o in Manner & form as the afd Jos: above against
him hath Complained Declared Wherefore the said Plft prays Judgm.t for his
Debt ^afd^ & his Dam.s Sustained by Occasion of the Detaining of the Same Debt to
him to be Adjudged &.a

                Therefore it is Considered that the afd Jos: MaClester recover against
the afd Peter Freany his Debt afd & his Dam.s by Occasion of ye Detaining
267   of the Same Debt to Two hundred & sixty seven               pounds of tob.o
to the Same Jos: of his assent by the Court here adjudged and the afd Deft
in Mercy &a

Memorandum the plft by Levin Gale his attorney sued out his Lordships writt of
Scirefacias against the deft the tenor whereof followeth in these words viz.t
Somersett fs  Charles absolute Lord and proprietary of the provinces of
                   Maryland and avalon Lord Baron of Baltemore &.c  ^To the Sher of Somersett County Greeting^ Whereas John Donelson Lately in
our County Court of Somersett here to witt the Sixteenth day of March anno Dom one thousand seven
hundred and twenty four before Samuel Hopkins Gentleman and his associates then Justices of Our same
Court at dividing Creek by Consideration of the Same Court Recovered against Roger Nicholson Jun.r
Late of Stepney Parish in ye Co.ty afd Marriner thirty five Shill.s Curr.t Mony & twelve
Hundred pounds of tob.o for his Dam.s which he Sustained as well by occasion of a Certain trespass
upon the Case by the Same Roger to ye Same John Lately Done as for his Costs & Charges
by him about his Suite in that part Expended whereof he is Convict as by the record & process
thereof in our Same Court before our Justices remaining Manifestly appeareth
And afterwards the ad Roger Nicholson in the Co.ty afd died Intestate as tis said after
whose Death Administration of all & Singular the Goods & Chattles rights & Creditts which
were of ye afd Roger Nicholson at ye time of his Death to a Certain Robert Collier of the
Co.ty afd in Due form of Law was Committed & altho' Judgm.t be thereupon rendered Nevertheless
Execution of the Dam.s afd to him as Yett remaineth to be made as by the Insinuation
of ye afd Jn.o we have received & we being Willing that those things which in our same Court
are rightfully Acted & Done Ought to be Duely Executed  We Command you that by Good
& Lawfull Men of your Balywick you Make Known unto the afd Robert Collier that
he be & appear before our Justices of Co.ty Co.t of Somrsett to be Held at Dividing Creek
the third tuesday of August Next to Shew Cause if any for himselfe he hath or to Say
Knoweth  Wherefore ye afd Jn.o Donelson his Execution of ye Dam.s afd against ye afd
Robert Collier to have ought not of ye Goods & Chattles which were of ye afd Roger Nicholson
at the time of his Death in ye Hands of ye Same Robert Collier remaining to be administred
if so much in his Hands he hath &.a  According to the force form & Effect of the recovery afd
if to him it Shall Seem Expedient & have you there then the Names of them before
whom you Make the Same Known and this Writt Wittness Sam.l Hopkins Gent
