                Att which said third tuesday of June to witt the Seventeenth day of the Same month
Anno Dom One thousand Seven hundred and twenty Nine before his Lordships Justices of the peace
for Somersett County at Dividing Creek Cometh the afd Mathew Tilghman Ward by his
attry afd & the Sher of the Co.ty afd to witt Jn.o Purnall Gent.m at ye Same Day
returned that he by Virtue of the Writt afd to him Directed Made Known to ye
afd Nath.l Horsey by Francis Porter and Richard Knight honest & Lawfull
Men of his Balywick that he be before his Lordships Justices at the Day
& place afd to Shew &.a  as to him it was Commanded Whereupon ye afd Nathl
Horsy so before Warned & at the Same Day being Solemnly Called Cometh
Not but Makes Default

                Therefore it is Considered that the afd Mathew Tilghman Ward
have Execution against the afd Nath.l Horsey of the Debt & Damages afd
&.a   And that ye afd Mathew Tilghman Ward According to the form of the
Statute in Such Case Lately Made & provided Recover against the afd Nath.l
203   Horsey Two hundred and Twenty four       pounds of tob.o for his Costs
Charges & Dam.s Sustained by ^occasion of^ Delay of Execution of the Debt & Dam.s afd by
pretext of the Writt afd here by Consent of ye afd Mathew Tilghman Ward taxed

            Sumoned to answer unto Jos: MaClester of a plea y.t
         he render unto him the full & Just Quantity of th two
thousand three Hundred & thirty pounds of tob.o which to him he
                Owes and Unjustly Detains &a

       And Whereupon the Same Jos: in his Own proper person Saith yt whereas
the afd Peter Freeney the twenty Ninth Day of May Anno Dom one thousand
Seven Hundred & twenty Seven at Somrsett County within the Jur of this Court
Certain Writing Obligatory Granted himselfe to be Held & firmly Bound to ye afd Jos:
In the afd Sum of two thousand three Hundred & thirty pd.s of tob.o to be paid ye Same
Jos: when afterwards he Should be thereto required  Nevertheless the said Peter
tho: often thereto required the afd two thousand three Hundred & thirty pounds of tob.o
or any part thereof to ye Same Jos: hath not paid but ye Same Hitherto to doe have
altogether Denyed & ye Said Peter the Same to Doe Still Doth Deny & Unjustly Detain
to the Damage of the Same Jos: two thousand pd.s of tob.o  And thereof he brings this
Suite &.a  And the said Jos: brings here into Court the Obligatory afd &a
                                                                Jos: MaClester Pledges &.a  J Doe R Roe

                And the afd Peter Freaney by Levin Gale his attry Comes and Defends the
force and Injury When &.a  And say's that he Cannot Gain say the Action afd of the
