       Att which said third tuesday of June to witt ye Seventeenth Day of ye Same Month
Anno Dom One thousand Seven Hundred & twenty Nine before his Lordships Justices of ye
Peace for Somrsett Co.ty at Dividing Creek Cometh ye afd Jos: MaClester by his attry
afd & the Sher of ye Co.ty afd to witt Jn.o Purnell Gent.m at ye Same Day returned
that he by virtue of the las Writt afd to him Directed be had Made Known to ye afd
Tobias Pepper by Benj.a Fosque and Joshua Sturgis Honest & Lawfull Men of his
Balywick that he be before his Lordships Justices at ye Day & place afd to shew
&.c  As to him it was Commanded  Whereupon the afd Tobias Pepper so before warned
And at ye Same Day being Solemnly Called Cometh not but Makes Default

             Therefore it is Considered that ye afd Jos: MaClester have Execution against
the afd Tobias Pepper of ye Dam.s afd according to ye force form & Effect of ye the
recovery afd &.a  And that ye afd Jos: MaClester according to ye form of ye Statute in Such
Case Lately Made & provided Recover against ye afd Tobias Pepper two hundred and
203   twenty four               pounds of tob.o for his Costs Charges and Damages Sustained
by Occasion of Delay of Execution of the Damages afd by pretext of ye Writt afd hereby
Consent of the afd Joseph MaClester Taxed &.a

Memorandum the Plft by francis Allen his attorney sued out his Lordships
writt of Scirefacias against the deft the tenor whereof followeth
in these words following viz.t
                                  Somersett fs   Charles absolute L.d & proprietary of ye provinces of Maryland
                & avalon Lord Baron of Baltemore &.a  To ye Sher of Somrsett Coty Greeting whereas
Mathew Tilghman Ward Lately in our Co.ty Co.t of Somrsett here to witt ye fifteenth
Day of June Anno Dom One thousand Seven Hundred & twenty five before Saml Hopkins
Gent.m & his associates then Our Justices of our Co.ty Co.t of Somrsett at Dividing
Creek by Consideration of the Same Co.t recovered against Nathell Horsey Late of
Somrsett Co.ty Marriner al.s Dict.s Nathell Horsey of Somrsett Co.ty in ye province
of Maryland Mariner as well a Certain Debt of Seven pd.s Seventeen Shill.s & Six pence
Curr.t Mony of this province as two Hundred & fifty three pd.s of tob.o which to
ye Same Mathew Tilghman Ward in our Same Court were adjudged for his Costs
& Dam.s which he Had by Occasion of ye Detaining of the Same Debt  Whereof
he is Convict as by the record & process thereof in our Same Co.t before our Justices
at Dividing Creek remaining Manifestly appeareth   Nevertheless Execution of ye
Judgm.t afd as Yett remaineth to be Made as by the Insinuation of the aforesaid Mathew
Tilghman Ward we have Received and because we are willing that those things which in our same
Court are rightfully done ought to be duely Executed   Command you that by honest and Lawfull
men of your Bailywick you make known unto the afd Nathaniel Horsey that he be before our
Justices of Our County Court of Somersett to be held at dividing the third tuesday of June next
to Shew Cause if any thing for himselfe he hath or to say Knoweth wherefore the afd Mathew
Tilghman Ward his Execution of the debt and damages afd he Ought not to have according to the
form of the Recovery afd if to him it seemeth Expedient and have you then and there the
