190 Att which said third tuesday of June to witt the Seventeenth day the Same month anno Dom one thousand Seven hundred and twenty Nine before his Lordships Justices of the peace for Somersett County at dividing Creek Cometh the afd Joseph Macclester by his attorney aforesaid and the Sherr of the County afd to witt John Purnall Gent at the same day Returned that he by virtue of the writt aforesaid to him directed he had made known to the afd Rodah Bowen by Edward Franklyn and William Ennett g honest and Lawfull men of his Bailywick that she be before his Lordships Justices at the day and place afd to Shew &.c as to him it was Commanded whereupon the afd Rodah Bowen so before warned and at the same day being solemnly Called Cometh not but makes default Therefore it is Considered that the afd Joseph Macclester have Execution against the afd Rodah Bowen of the Damages afd according to the force form and Effect of the recover afd &.c and that the afd Joseph Macclester according to the form of the Statute in Such Case Lately made and 206 provided Recover against the afd Rodah Bowen Two hundred & Six pounds of tobacco for his Costs Charges and Damages Sustained by Occasion of delay of Execution of the damages afd by pretext of the writt afd hereby Consent of the afd Joseph Macclester taxed &.c afterwards the Same day and year the afd Joseph MaClester present here in Court in his proper person Confesseth himselfe to be Satisfied of Six hundred and Eighty one pounds of tobacco part of the damages afd &.c therefore the same Rodah Bowen of the afd six hundred and Eighty One pounds of tobacco part of the damages afd be quiet &c
the fifteenth Day of March One thousand Seven Hundred & twenty five before Sam.l Hopkins Gent & his associates then Justices of our Said Co.t at Dividing Creek by Consideration of the Same Co.t Recovered Against Tobias Pepper Late of Somrsett Co.ty Planter Nine Hundred & Sixty two pd.s of tob.o for his Dam.s which he Sustained by occasion of a Certain promise & assumption to ye Same Jos: by ye afd Tobias Lately made & not performed Whereof he is Convict as by the record & process thereof in our Same Co.t before our Justices at Dividing Creek remaining Manifestly appeareth Nevertheless Execution of the Judgm.t afd as Yett remaineth to be Made as by the Insinuation of ye afd Jos we have received and because we are Willing that those things which in our Same Co.t are rightfully done Should be Duly Executed Command you that by honest & Lawfull Men of your Balywick you Make Known unto ye afd Tobias Pepper that he be before Our Justices of our Co.ty Co.t of Somrsett to be Held at Dividing Creek ye third tuesday of June Next to Shew Cause if any for himselfe he hath or Knoweth to say Wherefore ye afd Jos: his Execution Against him of ye Judgm.t afd Ought not to have According to ye form of ye recovery afd if unto him it Shall Seem Expedient & have you there the Names of them by whom to him you Make the Same Known & this Writt Wittness Sam.l Hopkins Gent Chief Justice of our Said Co.t &c 25th att |
