Videll Ought to have been Performed fullfilled and Kept according to the force form and affect of the
Condition of the Same writing Obligatory as he above ^by pleading^ hath alledged and do assess the damages of the
afd John Tunstall beyond his Costs and Charges ^by him about his suite^ in that part exposed to two thousand pounds of
tobacco and for those Costs and Charges to one pound of tobacco

                                     And because the Justices here themselves will advise of and upon the premises
and verdict afd before Judgm.t thereupon Rendered day is given to the Parties afd here untill the next
Court to hear thereof their Judgm.t for that the same Justices here thereupon as yett &.c

                Att which said next Court to witt the Seventeenth day of June ann.o Dom one thousand seven hundred
nd Twenty Nine Came againe as well the aforesaid John Tunstall by his attorney afd as the afd
John Videll in Custody as afd by his attorney afd and whereupon all and singular the premisses afd by the
Justices here ^being fully^ understood

                                                            Therefore it is Considered that the afd John Tunstall Recover against the
afd John Videll ^in Custody as afd^ his debt afd and his damages to two thousand and one pounds of tobacco by the Jurors afd
in form aforesaid assessed as also seven hundred and sixty six pounds of tobacco to the same John Tunstall
at his request for his Costs and Charges afd by the Court hereof his assent ^Increase^ adjudged which Certain Damage in the
whole do amount to two thousand seven hundred and sixty ^seven^ six pounds of tobacco and the afd Jno Videll in
Custody as afd ^in^ mercy &.c   Whereupon the Same day and Year abovesaid the said John Tunstall by his attry
afd being present herein Court Releaseth indemnified for three hundred and sixteen pounds ^sterling^ part of
the debt afd &.c  therefore the same Jno Videll in Custody as afd of the aforesaid three hundred and sixteen
pounds ^ster^ part of the debt afd be quiett &c

Memorandum the plft by Levin Gale his attorney sued outt his Lordships writt of
Scirefacias against the deft the tenor whereof followeth in these words viz.t
somersett fs  Charles absolute Lord and Proprietary of the provinces of
    Maryland and Avalon Lord Baron of Baltemore &.c  To the Sher of Somersett County Greeting whereas
    Jos: MaClester Lately in our Co.ty Co.t of Somrsett here to witt the twenty first Day of March
One thousand Seven Hundred & twenty Six before Sam.l Hopkins Gent & his associates then
Justices of our Said Co.t at Dividing Creek by Consideration of ye same Co.t recovered against
Rodah Bowen Late of Somrsett Co.ty Widdow One thousand five Hundred & Eighty three pd.s
of tob.o for his Dam.s which he Sustained by Occasion of a Certain promise & assumption to
the Same Jos: by ye afd Rodah made & not performed Whereof she is Convict as by the
Record & process thereof in our Same Cot before our Justices at Dividing Creek remaining
Manifestly appeareth  Nevertheless Execution of ye Judgm.t afd as Yett remaineth
to be Made as by the Insinuation of ye afd Jos: we have received & because we are Willing
that those things which in our Same Co.t are rightfully Done Should be Duely Executed Command
you that by Good & Lawfull Men of Your Balywick you Make Known unto ye
afd Rodah Bowen that she be before our Justices of our Co.ty Co.t of Somrsett to be Held at
Dividing Creek ye third tuesday of June Next to Shew Cause if any thing for herselfe she
hath or knoweth to say  Wherefore ye afd Jos: his Execution against her of ye Judgm.t afd ought
not to have according to ye form of ye recovery afd if unto her it Shall Seem Expedient & have
you then & there ye Names of them by whom to her you Make the Same Known & this Writt
