 Memorand.m the plft in his Own proper person sued out his Lordships writt of attachm.t

against the deft the tenor whereof followeth in these words viz.t
Charles absolute Lord and proprietary of the provinces of maryland and avalon Lord
            Baron of Baltemore &.c  To the sherr of Somersett County Greeting wee Command you that you attach
any the goods or Chattells Rights or Creditts of Ebenezer Cook if they shall be found in your Bailywick to
the value of two thousand pounds of tobacco and when you have the same attached or any part thereof
the same in your Custody Safe Keep so that you have the same before the Justices of Our County
Court to be held at dividing Creek the third tuesday of august Next to satisfie John Bishop of Nine
hundred and thirty seven pounds of tobacco which to the same John in Our Court before Our Justices
at dividing Creek according to the form of the statute thereof made and provided were adjudged for
his Costs and Charges which the same John sustained for that the afd H Ebenezer his ^writt in a^ Certain plea of
detinue &.c against the afd John in Our Court Impetrated and was not prosecuted whereof he is
Convict as also all Costs accrewing upon their Own writt of attachmt then and there to be Condemned
according to act of assembly and that by good and Lawfull men of your bailywick you make known
unto the person or persons in whose hands you make the same attachm.t that he she or they be
and appear before the Justices of our said County Court to be held as afd to shew Cause if any
he she or they have why the same goods Chattells Rights or Creditts so attached in his her or their
hands Ought not to be Condemned and Execution thereof had and made according to the form of
the act of assembly in such Case made and provided if to him her or them it shall seem mete
and how you shall Execute this writt that you make Known unto Our said Justices at the same
day and place afd and have you then and there this writt wittness Sam.l Hopkins Gent &c

    Att which said third tuesday of August to witt the fifteenth day of the Same month ann.o
  Dom One thousand seven hundred and twenty seven being the day of the Return of the said
writt Cometh the said John Bishop in his own proper person and the sherr of Somersett County to
whom the foregoeing writt was directed Likewise Cometh and maketh Return thereof Endorsed in
these words following viz.t  Attached full value in the hands of Coll Levin Gale and Sumoned
as garnishe          Fran: Allen sherr

             Whereupon the afd Levin Gale is garnishee of the afd Ebenezer Cook appears in
his own proper person and says that he Cannot gainsay but that he has of the Rights and Creditts of
the said Ebenezer Cook to the Value of twelve hundred pounds of tobacco nor but that the same ought
to be Condemned in his hands for the Use of the said John Bishop as of the rights and Creditts of the
said Ebenezer Cooke which the said plft doth not gainsay &c

           Whereupon the said John Bishop in his own proper person Prays that the afd sum
