187 and sixty four pounds of tobacco to be paid the Same Joseph when afterwards the same Bryan should be thereto required yett the aforesaid Bryan tho often thereto required the afd Sum of Eight hundred and Sixty four pounds of tobacco to the Same Joseph hath not Rendered but the said Bryan the same hitherto to do hath altogether refused and Still doth deny and unjustly detain whereby the same Joseph says he is worse and hath damage to the value of Eight hundred and Sixty pounds of tobacco and thereof he brings this Suite &.c and brings hereinto Court the writing Obligatory afd which the debt afd in form afd doth testefie whose date is the Same day and Year afd Jos: Macclester Pledges &c Jno Do R Roe And the afd Bryan Snee by Levin Gale his attorney Comes and defends the force and Injury when &.c and says that he Cannot Gainsay the action afd of the aforesaid ^Joseph^ Bryan nor Can he say but that the writing obligatory afd is the ^Deed^ fact of the same Bryan nor but that he Owes the Same Joseph the afd Eight hundred and Sixty four pounds of tobacco in manner and form as the afd Joseph above against him hath Complained declared wherefore the said plft prays Judgm.t for his debt afd and his damages sustained by Occasion of the detaining of the Same debt to him to be adjudged &c Therefore it is Considered that the afd Joseph Macclester Recover against the aforesaid Bryan Snee his debt afd and his damages by occasion of the detaining of the Same Debt to one 167 hundred & Sixty Seven pounds of tobacco to the Same Joseph of his assent by the Court here adjudged and the afd Defend.t in mercy &c
the Justices of his Lordships County Court of somersett to be held at dividing Creek the third tuesday of June then next to answer unto Robert Truman of a plea of trespass upon the Case &.c and that thereof he Should not fail &c And the afd Robert Truman by Levin Gale his attorney declared against the afd James Breeman in the Plea aforesaid as followeth vizt somersett fs James Breman late of Somersett County merch.t was attached to answer unto Robert Truman of a plea of trespass upon the Case &c And whereupon the Same Robert by Levin Gale his attorney Complains that whereas the aforesaid James the Eighth day of June anno Dom One thousand Seven hundred and Twenty Eight at somersett County within the Jurisdiction of this Court was Indebted unto the Same Robert in the Sum of Seven pounds twelve shillings and nine ^pence^ Currant mony as P account hereunto annexed and here into Court produced may appear and so thereof being Indebted the said James in Consideration thereof afterwards to witt the Same day and Year aforesaid at the County aforesaid and within the aforesaid Jurisdiction upon himselfe assumed and to the same Robert then and there faithfully promised that he when afterwards he should be thereto requested he the aforesaid Sum of Seven pounds Twelve shillings and nine pence to the same Robert would well and faithfully Content and pay Nevertheless the said James his promise and assumption afd in form afd made not regarding but plotting and fraudulently Intending him the same Robert in that part Craftilly and Subtilly to deceive and defraud the afd seven pounds Twelve shillings and |
