188 And nine or any part thereof to the same James he hath not paid altho' the Same to do the aforesaid Robert afterwards viz.t the Same day and year aforesaid at the County aforesaid and within the aforesaid Jurisdiction by the same Robert was requested but he the same hitherto to do hath altogether refused and still doth refuse whereby the Same Robert says he is worse and hath damage to the value of fifteen pounds five shillings and six pence Like mony and thereof he brings this Suite &c Levin Gale P Quer Pledges &.c Jno Doe R Roe
February ye 15.th 1728/9 Then Came before me the Subscriber One of his Lordships Justices of ye peace for Somersett County Robert Truman and Mary his wife and made Oath upon the holy Evangelist of Almighty that ye above acco.t is Just and true and that they have receive noe part nor percell more than Creditt they have given Creditt for sworn before me Jno Scott Att which said third tuesday of June to witt the Seventeenth day of the Same month anno Dom One thousand Seven hundred and Twenty Nine being the day of the return of the Said Writt Cometh the said Robert Truman by his attorney afd and the Sher of Somersett County to whom the foregoeing writt was directed Likewise Cometh and maketh Return thereof to the Court here Endorsed in these words following vizt Non est Inventus short note Left p Jno Purnall sher Whereupon the aforesaid Robert Truman by his attorney aforesaid prays that forasmuch as he has Complyed with the Law in order to an attachment he may have Judgmt against the afd James Breman for his damages by way of attachment according to act of assembly &.c wherefore for that it seems to ye Court here that the afd Robert Truman has Complyed with the Law as |
