Currant money of the said province which to them they owe and unjustly detaine &c And whereupon the said Francis Mercer and John Stewart by Francis Allen their attorney say that whereas the aforesaid Mercy whilst she was Sole to witt on the ninteenth day of July one thousand seven hundred and twenty Eight at Somersett County afd within the Jurisdiction of this Court by her Certain Writing Obligatory which ye Said Francis Mercer & Jno Stewart with the Seal of the Said Mercy Signed hereinto Co.t bring the Date whereof is ye Same Day & year Did Acknowledge herselfe to be Bound unto the Said Francis Mercer & Jn.o Stewart in the afd Fifty Six pd.s four Shills & Six pence to be paid to ye said Francis Mercer & Jno Stewart when She Shou'd be thereunto required Yett ye said Mercy Whilst She was sole nor ye afd Jn.o Lay & Mercy his wife since the Espousals between them Celebrated tho' often thereunto required ye Said Fifty Six pounds Four Shill.s & Six pence to ye afd Francis Mercer & Jn.o Stewart or to Either of them have not rendered but the Same to them hitherto to render have Denyed & still Do Deny & Injustly Detain To the Damage of the Said Francis Mercer & Jn.o Stewart of ten pd.s Mony afd And thereupon they bring Suite &c Fran: Allen P Quer Pledges &c J Doe R Roe And the afd John Lay and Mercy his wife in their Own proper person Come and defend the force and Injury when &c and say that they Cannot gainsay the action aforesaid of the aforesaid Francis ^Mercer^ and John ^Stewart^ nor Can they say but that the writing obligatory aforesaid is the fact of the same Mercy nor but that they Owe the same Francis ^Mercer^ and John Stewart the aforesaid fifty six pounds four Shillings and Six pence in manner and form as the afd Francis Mercer and John Stewart above against them have Complained wherefore the afd plfts pray Judgm.t for their debt afd and their damages sustained by Occasion of the detaining of the same Debt to him them to be adjudged &.c Therefore it is Considered that the afd Francis Mercer and John Stewart Recover against the afd John Lay and Mercy his wife their debt afd and their damage by Occasion of the detaining 400 of the same debt to four hundred pounds of tobacco to the Same Francis Mercer and John Stewart of their assent by their Court here adjudged and the afd Deft in Mercy &c
And Whereupon the same Joseph in his Own proper person saith that whereas the aforesaid Bryan Snee the twenty sixth day of August ann.o Dom One thousand Seven hundred and Twenty Seven at somersett County within the Jurisdiction of this Court by his Certain Writing Obligatory Granted himselfe to be held and firmly bound unto the same Joseph in the afd Sum of Eight hundred and |
