    County Court of Somersett to be held at Dividing Creek the third tuesday of June then next to answer
unto William Bratton of a plea that he Render unto him thirty pounds Currant money of Maryland
which to him he owes and and unjustly detaines &c

                And the aforesaid William Bratton by francis Allen his attorney declared against the said Tobias
Pepper in the plea afd as followeth viz.t   Somersett County fs      Tobias Pepper Late of Somersett
County Planter Otherwise Called Tobyas Pepper of Summersett County was Summoned to answer unto
he owes and unjustly detaines &.c   And whereupon the said William by Francis Allen his attorney saith
that whereas the aforesaid Tobias the twenty Sixth day of august one thousand seven hundred and twenty
Eight at Somersett County aforesaid within the Jurisdiction of this Court by his Certain Writing Obligatory
which the said William with the Seal of the Said Tobias signed hereinto Court brings the date whereof is
the same day and year did acknowledge himselfe to be bound unto the afd William in the aforesaid
thirty pounds money aforesaid to be paid to the Said William when he should be thereunto Required
yett the said Tobias tho' often Required the said thirty pounds to the said William hath not Rendered
but the same to him hitherto to Render hath denyed and still doth deny and unjustly detain to the
damage of the said William of ten pounds money aforesaid and thereof he brings Suite &.c

                   A Copy of the foregoeing declaration was made and sent to be Served on the defend.t with
the writt in the Plea aforesaid                     Att which said Next Court to witt the Seventeenth day of the
June month anno Dom One thousand Seven hundred and twenty Nine being the day of the return of
the said Writt Cometh the said William Bratton by his attorney aforesaid and the Sher of Somersett County
to whom the foregoeing writt was directed Likewise Cometh and maketh return thereof to the Court here
Endorsed in these words following vizt   Cepi Corpus P declaration delivered in time P Jno Purnall sher

             Whereupon the afd Tobias Pepper being Called appears and thereupon the said Tobias Pepper
at the prayer of the aforesaid William Bratton by his attorney aforesaid is adjudged to give speciall
bail to the action aforesaid but for want thereof the said Tobias Pepper is Committed into the Custody
of the Sherr of Somersett County there to remain &c

             And afterwards in the same Court Came a Certain Robert Scott of Somersett County Cordwainer and
undertakes for the said Tobias Pepper that if in Case the said Tobias William Bratton shall Recover
Judgm.t in the plea aforesaid against the aforesaid Tobias Pepper or that the said Tobias Pepper
Shall be therein Convict that then he the said Tobias Pepper shall pay the Condemnation of the Court
thereupon or render his body to the Custody of the Sher of Somersett County in Satisfaction thereof
or that he the said Robert Scott will do it for him

       And the aforesaid Tobias Pepper in his Own proper person Comes and defends the force & Injury
when &.c and Says that he Cannot Gainsay the action aforesaid of the afd William nor but that the
writing obligatory afd is the fact of ^him^ the same Tobias nor but that he Owes the same William the
aforesaid thirty pounds in manner and form as the aforesaid William above against him hath declared

          Therefore it is Considered that the afd William Bratton Recover against the afd Tobias Pepper
thirty pounds Currant mony his debt afd and his damages by Occasion of the detaining of the Same debt
368   to three hundred & Sixty Eight                        pounds of tobo to the Same William of his assent by
the Court here adjudged and the afd deft in mercy &c
