186 at the same day Returned that he by vertue of the writt aforesaid to him directed he had made known to the aforesaid Philip Taylor by Jacobus Arabia and Solomon Townsend honest and Lawfull men of his Bailywick aforesaid to be before his said Lordships Justices at the day and place afd to shew &.c as within to him it was Commanded Whereupon the afd Philip Taylor so before warned and at the Same day being solemnly Called Cometh not but makes default Therefore it is Considered that the afd James Dickerson have Execution against the aforesaid Philip Taylor of the afd seven hundred and Thirty four pounds of tob.o his damages afd by default Likewise the aforesaid James Dickerson according to the form of the Statute in Such Case Lately made and provided Recover against the afd Philip Taylor two hundred & thirty 212 three pounds of tobacco for his Costs and Charges and damages which he Sustained by Occasion of delay of Execution of the damages afd by pretext of the writt of Scirefacias afd here by the Consent of the afd James Dickerson taxed &c
dividing Creek the third tuesday of June then next to answer unto John Tunstall of a plea of trespass upon the Case &c and that thereof he Should not fail &c Att which said third tuesday of June to witt the Seventeenth day of the Same month ann Dom One thousand Seven hundred and Twenty Nine being the day of the return of the Said Writt Cometh the said John Tunstall for his own proper person and the sher of Somersett County to whom the foregoeing writt was directed Likewise Cometh and maketh return thereof to the Court here Endorsed viz.t Cepi Corpus P John Purnall sher And the afd Richard Hubbard by francis Allen his attorney Comes and defends the force & Injury when &.c and offers himselfe against the aforesaid John Tunstall in the plea afd but the said John Tunstall altho' Solemnly Called Cometh not Nor is his writt against the afd Richard Hubbard further prosecuted &.c Therefore he and his pledges of Prosecuting being in mercy let the said John Tunstall name the pledges and that the aforesaid Richard Hubbard goe thereof without day also it is Considered that the afd Richard Hubbard Recover against the aforesaid John Tunstall his damages by Occasion of the premisses to One hundred & forty three pounds of tobacco 143 to the same Richard by discretion of the Justices here at his request for his Costs and Charges in that part sustained according to the form of Statute &.c by the Court here adjudged &.c
