185 Guilty of the trespass and assault aforesaid above upon him Imposed and puts himselfe upon the favour of the Court &.c Wherefore it is Considered by the Court that the afd Thomas Peal be taken to satisfie his said Lordship of the fine aforesaid by Occasion of the trespass and assault which same Thomas Peal then and there present in Court aforesaid prays himselfe at fine with his said Lordship by Occasion aforesaid and thereof he puts himselfe in mercy of his said Lordship and the fine of the same Thomas Peal by the Justices aforesaid is assessed to two hundred pounds of tobacco to the use of his said Lordship thereupon the afd Thomas Peal is discharged paying the severall officers their fees &c Mary Patrick appears according to her Recognizance entered into to give Evidence against a Certain Samuel Bratton and is discharged therefrom &c Thomas Holbrook appears according to his Recognizance for his good behaviour toward a Certain Thomas Goddard and is discharged therefrom &c Achsah Lawrence appears according to her Recognizance for to give Evidence against a Certain Robert Scott and is discharged therefrom &c Adam Spence Jun.r appears and produceth a receipt that he had paid away all the Estate of Catherine Woods and is discharged from the Ballance thereof &c
Dickerson lately in Our County Court of Somersett hereto witt the Sixteenth day of August one thousand Seven Hundred & twenty Six before Sam.l Hopkins Gent.m & his associates then Justices of our Said Co.t at Dividing Creek & by Consideration of the Same Co.t Recovered Against Philip Taylor Late of Somrsett Co.ty Planter Seven Hundred & thirty four pounds of tob.o for his Dam.s which he Sustained by Occasion of a Certain Promise & assumption to the Same James by the afd Phillip Lately Made & not Performed Whereof he is Convict as by the record & process thereof in our Same Co.t before our Justices at Dividing Creek remaining Manifestly appeareth Nevertheless Execution of the Judgm.t afd as Yett remaineth to be Made as by the Insinuation of the afd James we have received & because we are Willing that those things which in our Same Court are rightfully Done Should be Duely Executed We Command you that by Honest & Lawfull Men of your Balywick you Make Known unto the afd Phillip Tayler that he be before our Justices of our Co.ty Co.t of Somrsett to be Held at Dividing Creek the third tuesday of June Next to Shew Cause if any for himselfe he hath or Knoweth to say Wherefore ye afd James Dickenson Execution against him of the Judgm.t afd Ought not to have According to the form of the recovery afd if to him it Shall Seem Expedient & have you there the Names of them by whom to him you Make the Same Known & this Writt Wittness Sam.l Hopkins Gent.m Chief Justice of our Said Court &c Att which said third tuesday of June to witt the Seventeenth day of the Same month anno Dom one thousand Seven hundred and twenty Nine being the day of the Return of the afd writt Cometh the afd James Dickerson by his attorney afd and the Sher of Somersett County to witt John Purnall Gentl at |
