185 and him beat wound and Evilly treated so that of his Life it was despaired and other harmes to him then and there did do to the great Damage of the said Francis Mercer and against the peace of Our said Lord Proprietary his good rule and dignity wherefore the said George Dashiell for the said Lord Proprietor prays advisement of the Court herein the premisses and that due process of Law may Issue G Dashiell P Dom Prorter Thereupon Command was Given to the Sher of Somersett County that he should take the said Thomas Peal if &.c to answer &.c and afterwards in the same Court Came the said Thomas Peal in his proper person and the aforesaid Information being unto him read submits with a protestation of his Innocency and becaus he will not Plead with the said Lord Proprietor he putts himselfe upon the favour of the Court &.c Wherefore it is Considered by the Court that the afd Thomas Peal be taken to Satisfie his said Lordship of his fine by Occasion of the trespass and assault afd which same Thomas Peal then and there present in Court afd prays he may be admitted at fine ^with^ of his said Lordship by Occasion aforesaid and thereof he putts himselfe in Mercy of his said Lordship and the fine of the said Thomas Peal is assesses by the Justices to fifty hundred pounds of tobacco to the use of his said Lordship the Lord Proprietor &.c and thereupon the said Thomas Peal is discharged &.c
Proprietor of this province that now is and Gives the Court to understand and be Informed that a Certain Thomas Peal late of Coventry parish in somersett County planter on the ninth day of May One thousand Seven hundred and Twenty Nine with force and armes &.c at the parish afd in the County afd within the Jurisdiction of this Court in and upon a Certain Sarah Mercer wife of Francis Mercer Merch.t in the peace of God and Our said Lord proprietary then and there being an assault did make and her did beat wound and evilly treated so that of her Life it was dispaired and other harmes to her then and there did do to the great Damage of the said Sarah Mercer and against the peace of our said Lord proprietary his good rule and dignity wherefore the said George Dashiell for his said Lord proprietary prays advisement of the Court herein the premisses and that due process of Law may Issue Geo. Dashiell P Dom Propry Thereupon Command was given to the Sher of Somersett County that he should take ye said Thomas Peal if &.c to answer &.c and afterwards in the ^same^ Court Came the the Said Thomas Peal in his Own proper person and hath hearing of the Information afd and Says that he is not thereof Guilty and of this he putts himselfe upon the Country and George Dashiell who for his said Lordship in that part follows Likewise &.c And whereupon the aforesaid Thomas Peal Relinquisheth his verification aforesaid by him above pretended says that he Cannot deny but that he is Guilty |
