(181) that the said Sum of five pounds Eighteen shillings and Six pence he would well and truly content and pay when he should be thereto requested Nevertheless the Same James his promise and assumption afd in form afd made Little Regarding but plotting and fraudulently Intending the Same Alexander in that part to defraud the Same he hath not paid nor in any ways Contented but the Same to pay hath Refused and Still doth refuse to the said Damage of the said Alexander twelve pounds Currant money of maryland and thereof he brings this Suite &c Dashiell P Quer Pledges &c Jno Doe Richd Roe And whereupon the said James Jones by in his ^own^ proper person Comes and defends the force and Injury when &.c and says that he Cannot Gainsay the action aforesaid of the afd Alexd nor but that he did assume upon himselfe in manner and form as the afd Alexander above against him hath Complained and as to the damage of the Same Alexander by him by Occasion of the premisses in that part Sustained ^the Same James says and Confesseth that the afd Alexander hath sustained Damages^ by occasioned of the premisses besides his Costs and Charges by him about his Suit in that part Expended to to five pounds Eighteen shillings and six pence and because the afd Alexander denys not this but the Same allegation Confesseth to be true prays Judgm.t and those Damages above Confessed together with his Costs and Charges afd to him adjudged &c Therefore it is Considered by Consent of the parties afd that the afd that the afd Alexander Draper Recover against the afd James Jones his damages afd to five pounds Eighteen shillings and Six pence by the Same James in form afd Confessed as also two hundred and Twenty Eight pounds of tobacco for his Costs and Charges afd to the same Alexander at his request by the Court hereof and Consent of the parties afd adjudged which Certain Damages in the whole do amount too Six p five pounds Eighteen shillings and Six pence and two hundred and twenty Eight pounds of tobacco and the afd James in Mercy &.c June ye 15th 1727 James Jones D.r 1726 to Alexander Draper
Memorandum the above account should have been Entered at the foot of the declaration but was Omitted and is Entered here &c The Court adjourns till the third tuesday of June Next Ann.o 1729 |
