176 Called Simpleton told him ye Said Jn.o Bishop yt ye Line of Duram House land on yt Side ran Close by ye Ceader tree afd & further yt ye Said Line ran into Selby's Bay Leaveing all ye trees or woods to Selbys side & ye Said Jno Bishop Declared yt ye afd Tho.s Selby told him yt his Land Called Simpleton ran along by ye afd Ceader tree as did ye afd Duram House Land & further ye afd Jno Bishop Carried us unto A Small Hickory tree Standing about Sixty yards to ye Northward of a path yt Leeds from Bennocey Edwards to M.r W.m Whittingtons & Declared yt his father told him yt that Hickory tree was a line tree of duram House Land & from thence ye Said Jno Bishop Carried us unto a place Called Patricks Spring & Shewed us two read Oaks trees Standing some what to ye Southward of ye Said Spring & Declared on his Oath afd yt Jn.o Patrick now declared deceased told him yt ye Said Jn.o Patrick's father Rory Patrick made [illegible] Charged him ye afd Jn.o Patrick that he Should not Cutt down any Timber or Smaller trees or Other Woods to ye Southward of those read Oak trees for fear of being Troubled by Henry Bishop Owner of ye Land Called Duram House Land for by them trees was ye Bounder & yt his father Rory Patrick helped to Carry ye Chain at ye Survey of Duram House Land. The third Evidence Examined was Jn.o Scarbrough who on his Oath Declared yt his father Mathew Scarbrough Shewed him ye Same Gum tree Declared by Cap.t Nath.l Hopkins & told him it was ye Second Corner tree of Duram House Land Standing on the Head of the North Line & yt he heard his father say he was one of the Chain Carriers at ye Survey of ye Said Land & further Declares yt Jn.o Patrick now dec.d told him yt his father Charged him not to Cutt any fence Loggs Stakes or Other Timber to ye Southward of ye two Oakes by Patricks Spring afd in Jn.o Bishops Examination as afd &a The afd Examinations taken In Pursuance of ye afd Commission on the 16th & 17th day's of July Ann.o Dom 1728 Jn.o Purnell By Johnson Hill Edward round
