175 William West says that he Can not Gainsay the action afd of the afd James nor can he Say but that but that the bond or writing Obligatory aforesaid is his act and deed nor Can he Say but that he doth detain from the afd James the afd Sixteen pounds five shillings Lawfull mony of america in manner and form as the afd James above against him hath Complained Therefore it is Considered that the afd James Breman Administrator of the afd George Gibbs Recover against the afd William West his deb Sixteen pounds five shillings Lawfull mony of america his debt afd as also his damages by Occasion of the detaining of the Same debt to three hundred and Eighty pounds of tobacco to the Same James by the Court her of his assent adjudged and the afd Deft in mery &c
pounds One shilling and three pence and One hundred Gallons of Sider which to him he owes and unjustly detaines &c And whereupon the said Christopher by francis Allen his attorney saith that whereas the afd William the Ninth day of may anno Dom One thousand Seven hundred and twenty Eight at Somersett County within the Jurisdiction of this Court by his Certain writing Obligatory ^which the^ aforesaid Christopher with the Seal of the said William signed hereinto Court brings whose date is the same day and year did acknowledge himselfe to be bound unto the said Christopher when he should be thereunto required Nevertheless the said William tho' often required the said Six pounds One shilling and three pence and One hundred Gallons of Cyder to the aforesaid Christopher hath not Rendered but the same to him hitherto to render hath denyed and Still doth deny and unjustly detaine whereupon the said Christopher saith he is worse and hath damage to the value of fifteen pounds Curr.t mony of Maryland and thereupon he brings Suite &.c F Allen P Que Pledgs &.a Jno Doe R Roe And the aforesaid William Porter by in his Own proper person Comes and defends the force and Injury when &.c and prays Leave to Imparle hereunto untill the next Court & he hath it and the Same day is given to the afd Plft here also &c Att which said next Court to witt the Eighteenth day of March ann.o Dom One thousand seven hundred and twenty Eight Came again the afd Christopher Glass by his attorney afd and prays that the afd William Porter to his declaration afd may answer but the afd William Porter altho at the same day Solemnly Called Cometh not nor nothing says in barr or preclusion of the action afd of the afd Christopher ^says^ by which the same plft remaineth against the afd deft thereof undefended &a Therefore it is considered that the afd Christopher Glass Recover against the afd W.m Porter Six pounds One shilling and three pence and one hundred gallons of sider his debt afd and his damages by Occasion of the detaining of the Same debt to two hundred and forty Nine pounds of tob.o to the same Christopher of his assent by the Court here adjudged and the afd Deft in mercy &a |
