174 Commanded and now hereafterwards to witt the Same day and year Came as well the aforesaid Plft as the afd deft by their attorneys afd and the Jurors of that Jury therein Impannelled being Called Likewise Came to witt Thomas Humphrys Samuel Taylor, William Simpson, James Thompson, Teague Riggin Robert Collier, Peter frazer, John Broughton, John Harris, George Benston, Daniel Maddox, and Thomas Holbrook who being Duely Elected tryed and Sworn to Say the truth in the premises upon their oath do Say that that the said Andrew Thompson did not assume upon himselfe in manner and form of as the afd Margarett above against him hath Complained &c Therefore it is Considered that the afd Margarett Waile take nothing by her writt afd but that she be in Mercy for her folie Clamour &c and that the afd Andrew Thompson Goe thereof without day &c and further it is Considered that the afd Andrew Thompson Recover against the afd Margarett Waile Six hundred and forty four pounds of tobacco for his Costs and Charges by him about his defence in that part Sustained to the Same Andrew by the Court hereof his assent according to the form of the form of Statute in such Case Lately made and provided adjudged and that the afd Andrew have thereof Ex.n &c
of america which from him he unjustly detaines &a And whereupon ye s.d James by Levin Gale his attry saith yt whereas ye said W.m ye thirtieth day of Novem.r Ann.o Dom one thousand Seven Hundred & twenty Seven at Somrsett Co.ty afd within ye Jur of this Co.t by his Certain Writing Obligatory which ye Said James with ye Seal of ye Said William Signed hereinto Co.t Brings ye Date whereof is ye same day & year did Acknowledge himselfe to be Bound unto ye Said Geo in his lifetime in ye afd Sixteen pd.s five Shills mony afd to be paid unto the Said Geo when he Should be thereunto required yett ye said W.m tho' often required ye Said Sixteen pd.s five Shills to ye Said Geo in his Lifetime or to ye afd James since ye decease of ye Said Geo: in his Lifetime said Capacity hath not rendered but ye Same to ye Said Geo: in his Lifetime to render hath Denyed & ye Said W.m ye Same to ye Said James to render Still doth deny & unjustly Detain to ye Damage of ye Said James of Six pd.s Mony afd & thereof he brings Suite &a And Brings into Court here his Letters of Admrcon by which &a L Gale P Quer Pledges &.a J Doe R Roe And ye afd W.m West in his own proper person Comes & Defends ye force and Injury when &.a & prays Leave to Imparle hereunto untill ye Next Co.t & he hath it & ye Same day is given to ye afd Plft here also &a Att which said Next Court to witt ye Eighteenth day of March Anno Dom One thousand Seven Hundred & twenty Eight Came again as well ye afd James Breman by his attry afd as ye afd W.m West in his own Proper person and the said W.m |
