174 Said Andrew to Husband he ye said Andrew upon himselfe assumed to ye Same Magrett then & there faithfully did promise yt he ye Said Andrew wou'd take to wife ye said Margrett & although ye Said Margrett haveing ye faith & Confidence in ye promise & assumption afd of ye afd Andrew Matrimony with all Other persons to Contract hath Altogether refused & Still unmaried is & always from the time of Makeing ye promise & assumption afd was ready & often offered to take ye Said Andrew for her Lawfull Husband viz.t at Somrsett Co.ty afd Nevertheless ye Said Andrew his promise and assumption afd in form afd made Little regarding butt Plotting & fraudulently Intending her ye Said Marg.tt in yt part Craftilly & Subtilly to defraud and Deceive the said Andrew ye Said Marg.tt to wife hath not taken altho ye Same to Doe the afd Andrew after ye Makeing the promise & assumption afd yt is to say ye tenth day of aprill Ann.o Dom One thousand Seven Hundred & twenty Eight & often before & afterwards at Somrsett Co.ty afd within ye afd Jur by ye Same Marg.tt was [illegible] ye said [illegible] altogether refused & still doth refuse whereby ye Same Margrett say's she is worse & hath Dam to ye Value of One Hundred pd.s Curr.t Mony of Maryland & thereof she brings this Suite &a L Gale P Quer pledges &.a J Doe R Roe And the afd Andrew Thompson by Fran Allen his Attry Comes & Defends ye force & Injury when &.a And pray's leave to Imparle hereunto untill ye Next Court & he hath it & the Same day is given to ye afd Plft here also &a Att which said Next Court to witt ye Nineteenth day of Novem Anno Dom one thousand Seven Hundred & twenty Eight Came again as well ye afd Plft as ye afd Deft by their attry's afd & thereupon ye afd Deft by his said attry pray's further Leave to Imparle hereunto untill ye Next Co.t & he hath it & ye Same day is given to ye afd Plft here also &a Att which said Next Court to witt ye Eighteenth day of March anno Dom One thousand Seven Hundred & twenty Eight Came again as well ye afd Plft as ye afd Deft by their attry's afd and thereupon the Same Andrew by his said attorney afd prays that the said Margrett Waile may give Security for Costs in Case nonsuite may be Obtained against her in the plea aforesaid which is by the Court Granted Whereupon a Certain Levin Gale of Somersett County Gent.m present herein Court in his proper person undertakes for the said Margrett Waile that in Case she be nonsuited in the plea afd or Otherwise Legally Cost that then the said Marg.tt Waile shall pay the Condemnation of the Court thereupon and al Costs accrewing to the Said Andrew Thompson or that the said Levin Gale will do it for her &.a thereupon the said Andrew Thompson by his attorney afd as before defends the force and Injury when &.a and saith that he did not assume upon himselfe in manner and form as the said Margarett above against him hath Complained and of this he puts himselfe upon the Country and the afd Plft Likewise Thereupon Command is given to the Sher of Somersett ^County^ that Immediately he Cause to Come he twelve &.a by whom &.a to recognize &.a who neither &.a because as well &.a of which said preceipt the said Sher to witt John Purnall Gentleman now hereat to witt the Same day and year last mentioned makes Return that he hath here ready twelve &.a as by his said preceipt he was Commanded |
