Command was given to the Sher of Somersett County that he should ^take^ Rachel

Alexander Executrix of the last will and testament of Henry Alexander late
of Somersett County dec.d planter if she shall be found in his bailywick &
                her safe keep so that he might have her body before his Lordships Justices of the County ^Court^
of Somersett to be held at Dividing Creek the third tuesday of August then next to answer unto
William Whittington of a plea of trespass upon the Case &c and that thereof he should not fail &c

                Att which said next Court to witt the fifteenth day of August Ann.o Dom One thousand seven
hundred and twenty Eight being the day of the Return of the afd writt Cometh the afd William Whittington
by Levin Gale his attorney and the Sher of Somersett County to whom the foregoeing writt was directed
Likewise Cometh and maketh return thereof to the Court here Endorsed vizt Cepi Corpus P fran: Allen sher

                And the afd Rachell by francis Allen her attorney comes and defends the force and Injury when &.a
and prays Leave to Imparle hereunto untill the next Court and he hath it and the Same day is Given to the
plft here also                  Att which said next Court to witt the ninteenth day of august anno Dom one
thousand Seven hundred and twenty Eight Comes again as well the afd William as the afd Rachel
by their attorneys afd and the said [illegible]
to Imparle hereunto untill the next Court and she hath it and the Same day is given to the plft here
also &c         Att which said next Court to witt the Eighteenth day March anno Dom One thousand seven
hundred and twenty Eight Came again as well the afd William as the afd Rachell by their attorneys afd
and thereupon the afd Rachel by her ^said^ attorney prays that the afd William may declare to the action afd in
the plea afd whereupon time is given to the afd William untill the afternoon of the Same day to
declare to the action afd and it is said unto the said William ^by the Court^ that he declare at the Same time

       And afterwards Came the said Rachel by her attorney afd and the afd William altho' Solemnly
called Cometh not nor nor declareth he to the action afd nor is ^his^ writt against the afd Rachell further
prosecuted &.a
                             Therefore it is Considered that the afd William Whittington and his pledges of Prosecuting
be in mercy and that the said William Name his pledges &c and that the afd Rachell Alexander
go thereof without day also it is Considered that the afd Rachel Recover against the afd William her
damages by Occasion of the premises to One hundred and Seventy three pounds of tobacco to the same
Rachel by discretion of the Justices here at her request for her Costs and Charges in that part Sustained
according to the form of the Statute thereof Lately made and provided by the Court here adjudged &.c

was attached to answer unto Marg.t Waile of a plea of trespass upon the
case &.a  And whereupon the Same Marg.t by Levin Gale her
attorney Complains that whereas the afd Andrew Thompson whilst he was sole & unmarried
that is to say the tenth day of March Anno Dom One thousand Seven Hundred & twenty
Seven at Somrsett Co.ty within ye Jur of this Co.t In Consideration yt ye Same Margrett
then & Still sole & Unmarried being at ye Especiall Instance & request of ye Same
Andrew then & there Had agreed with ye Said Andrew & upon herselfe assumed &
to the Said Andrew faithfully Promised yt she the Said Margrett would take ye
