 Somersett fs  Nathaniel Horsey late of somersett County mariner al.s dict
Nathaniel Horsey marriner of Somersett County maryland was Sumoned
to answer unto William Horsey of a plea that he Render unto him the sum
of One hundred pounds currant mony which to him he Owes and unjustly detaines &.a

And whereupon the Same William by Levin Gale his attry Saith that Whereas ye afd
Nathaniel ye twenty fourth day of febry Ann.o Dom One thousand Seven Hundred & Eighteen
at Somrsett County within the Jur of this Court by his Certain Writing Obligatory Granted
himselfe to be Held & firmly Bound unto the same William in the afd Sum of One hundred
pounds of Curr.t Mony to be paid the Same William when afterwards ye Said Nathaniel
Shou'd be thereto required yett ye afd Nathaniel though often thereto required ye afd sum
of One Hundred pounds Curr.t Mony to the Same William hath not rendered but ye said
Nathaniel ye Same Hitherto to doe hath altogether denyed & Still doth deny and
unjustly detain whereby the same William say's he is worse & hath Dam to ye value of
One Hundred pd.s Curr.t Mony & thereof he brings this Suite &.a  And the Same William
Brings hereinto Court ye Writing Obligatory afd Which ye Debt afd in form afd Wittnesseth
whose Date is the Same Day & year afd &a

    And the afd Nathaniel Horsey by George Dashiel his attorney Comes and defends the force and
    Injury when &.a and prays Leave to Imparle hereunto untill the next Court and he hath it and the
    the same day is given to the afd Plft &c

                Att which said next Court to witt the fifteen day of August anno Dom One thousand Seven
hundred and Twenty Eight Came againe as well the afd Wm Horsey as the afd Nathaniel Horsey
by their attorneys afd and whereupon the dispute in this action is by the Court and Consent of the
parties aforesaid Refered to Robert King, John Jones and William Stoughton Gentlemen or
any two of them according to the form of the Statute and Judgmt to be on their Return as of
this Court thereupon further day is Given tot he afd Plft and deft to hear thereof their
Judgm.t untill next Court &c

                         Att which said next Court to witt the ninteenth day of November anno Dom one thousand
seven hundred and Twenty Eight Came again as well the afd Plft as the afd deft by their attorneys
afd but the afd Arbitrators Returns not their award in the premisses afd thereupon further day
is given unto the afd Plft and deft to hear thereof their Judgmt in the premisses afd untill the
next Court &.c
                               Att which said next Court to witt the Eighteenth day of March anno Dom one thousand
seven Hundred and Eighteen Came again as well the afd Plft as the afd deft by their attorneys
aforesaid Likewise Came John Jones and William Stoughton Gent.m two of the persons mentioned
in the rule of referrence and make return of their award in the premisses as followeth viz.t

    To the worshipfull Justices within mentioned wee John Jones and William Stoughton do Certifie
    that we have Examined into the premisses within Mentioned pursuant ^to^ the power within vested in us
    and do find that the action within mentioned is brought upon an Obligation passed by the
    within Nathaniell Horsey unto the within Wm Horsey for one hundred pounds Curr.t mony
