1728 166 Archibald Deal Robert Collier, Peter frazer, W.m Handy, John Harris, George Benston, Daniel Maddox, Thomas Holbrook who being duely Elected tryed and Sworn to say the truth in the premisses upon their oath do say that the afd Elizabeth Standley did assume upon herselfe in manner and form as the aforesaid Eliz.a Riggin above against her hath Complained and do assess the damages of the Same Elizabeth Riggin by Occasion of the non performance of the promise and assumption aforesaid besides her costs and Charges by her about her suit in that part Expended to five hundred pounds of tobacco and for those Costs and Charges to one pound of tobacco Therefore it is Considered by the Court here that the aforesaid Elizabeth Riggin Recover against the afd Elizabeth Standley her damages aforesaid by the Jurors aforesaid in form afd assessed to five hundred ^one^ and pounds of tobacco as also seven hundred and twelve pounds of tobacco for her Costs and Charges to the same Eliza Riggin by the Court here of her assent of Increase adjudged which Certain damages in the whole do amount to twelve hundred and thirteen pounds of tobacco and the afd deft in mercy &a
of a plea of trespass &.a and that thereof he should not fail &a Att which said third tuesday of June to witt the twentieth day of the same month anno Dom one thousand seven hundred and twenty Eight being the day of the Return of the said Writt cometh the afd Dennis folio by his attorney aforesaid and the Sher of Somersett County to whom the foregoeing was directed Likewise Cometh and maketh Return thereof to the Court here Endorsed in these words following viz.t Cepi Corpus p fran Allen sher And the aforesaid Henry Schofeild by Robert Peirce his attorney comes and defends the force and Injury when &.c and prays Leave to Imparle hereunto untill the next Court and he hath it and the same day is given to the Plft here also Att which said Next Court to witt the fifteenth day of august ann.o Dom One thousand One thousand Seven hundred and twenty Eight Came again as well the aforesaid Plft as the afd deft by their attorneys aforesaid and thereupon the afd Henry Deft ^by his said attorney^ prays further Leave to Imparle hereunto untill the next Court and he hath it and the Same day is given to the aforesaid Plft here also Att which said Next Court to witt ye Nineteenth day of November Anno Dom One thousand Seven Hundred & twenty Eight Came again as well the afd Plft as ye afd Deft by their attry's afd, & thereupon ye afd Deft by his said Attry pray's further leave to Imparle hereunto untill the Next Court & he hath it & ye same day is given to the afd Plft here also Att which said Next Court to witt ye Eighteenth day of March Anno Dom one thousand Seven Hundred & twenty Eight Came again as well the afd Plft as ye afd Deft by their attrys afd and the afd deft by his said attorney and offers himselfe against the afd Plft in the Plea afd but because the afd Plft does not declare against the afd Deft in the plea afd Therefore he and his pledges of Prosecuting be in mercy and that the Names of his pledges be sought for &.a And that the afd Henry Schofeild goe thereof without day also it is Considered that the afd Henry Schofeild an Recover against the aforesaid Dennis folio his damages by occasion of the premises to one hundred & seventy two pounds of tobacco to the same Deft by direction of the Justices here at his request for his Costs and Charges in that Part Sustained according to the form of the Statute &a |
