166 then and there faithfully promised that she when afterwards she Should be thereunto requested she the aforesaid Sum of five hundred pounds of tobacco to the Same Riggin would well and faithfully Content and pay Nevertheless the said Elizabeth Standley her promise and assumption aforesaid in form aforesaid made not regarding but Plotting and fraudulently Intending him the Same Riggin in that part Craftilly and Subtilly to deceive and defraud the aforesaid Standley the aforesaid Sum of five hundred pounds of tobacco or any Part thereof to the same Riggin hath not paid altho' the Same to do the afd Standly afterwards viz.t the same day and year afd at the County afd and within the aforesaid Jurisdiction by the Same Riggin was Requested but the Same hitherto to do hath altogether Refused and Still doth refuse whereby the same Riggin says she is worse and hath damage to the value of One thousand pounds of tobacco and thereof he brings this Suite &.a Elizabeth standley D.r ll tobacco To meat drink Lodging and Services done you P your agreement 500 proved by Eliz.a Riggin in Open Court in Common form Thomas Hayward Clk And the said Elizabeth Standley by George Dashiell her attorney Comes and defends the force and Injury when &.a and prays Leave to Imparle hereunto untill the next Court and she hath it and the Same day is given to the afd Plft here also &.a Att which said next Court to witt the Fifteenth day of august anno Dom one thousand Seven hundred and twenty Eight Came again as well the afd Plft as the afd deft by their attorneys afd and the afd Deft by her said Attorney prays further Leave to Imparle hereunto untill the next Court and she hath it and the Same day is given to the aforesaid Plft here also &a Att which said next Court ^to witt^ the ninteenth day of November anno Dom One thousand seven hundred and twenty Eight Came gain as well the afd Plft as the afd deft by their attorneys afd and the afd Deft by her said attorney prays further Leave to Imparle hereunto untill the next Court and she hath it and the same day is given to the aforesaid Plft here also Att which said next Court to witt the Eighteenth day of march anno Dom One thousand Seven hundred and Twenty Eight Came again as well the afd Plft as the aforesaid deft by their attorneys afd and the aforesaid deft by her said attorney as before defends the force and Injury when &.a and saith that she did not assume upon herselfe in manner and form as the plft above against her hath Complained and of this she putts herselfe upon the Country and the plft in like manner Thereupon Command is Given to the sher of Somersett County that Immediately he cause to come here twelve &c by whom &c who neither &c to recognize &c because as well &c of which said preceipt the said Sher to witt John Purnall Gent Now here at this day to witt the same day and year Last mentioned makes Return that he has here Ready twelve &.c as by his Said preceipt he was Commanded and now hereafterwards to witt the Same day and Came as well the afd Plft as the afd deft by their attorneys afd and the Jurors of that Jury therein Impannelled being Called Likewise Came to witt Thomas Humphrys, Sam.l Taylor W.m Simpson, James Thompson Archibald |
