165 Joseph Pemberton ^and the said Jos Pemberton^ puts in his place francis Allen Gent.m attorney att Law against the afd and the said Joseph Pemberton by his said attorney prays further leave to Imparle hereunto untill the next Court and he hath it and the same day is Given to the aforesaid plft here also Att which said next Court to witt the ninteenth day of November Anno Dom One thousand Seven hundred and Twenty Eight Came again as well the afd Isaac Handy as the afd Joseph Pemberton by their attorneys aforesaid and thereupon the aforesaid Joseph by his said attorney prayed further leave to Imparle hereunto untill the next Court and he hath it and the Same day is give to the afd plft here also Att which said next Court to witt the Eighteenth day of March anno Dom one thousand Seven hundred and Twenty Eight Came again as well the afd Isaac Handy is the aforesaid Joseph Pemberton by their attorneys aforesaid and the aforesaid Joseph by his said attorney as before defends the force and Injury when &c and says that he did not assume upon himselfe in manner and form as the aforesaid Isaac above against him hath Complained and of this he putts himselfe upon the Country and the afd Plft in like manner Thereupon Command was given to the Sher of Somersett County that Immediately he Cause to Come here twelve &.a by whom &.a who neither &.a to Recognize &.a because as well &.a of which said preceipt the Said sher to witt John Purnall Gent now hereat this day to witt eh Same day and year Last mentioned makes Returne that he hath here ready twelve &.a as by his said preceipt he was Commanded and now hereafterwards to witt the same day and year Came as well the aforesaid plft as the aforesaid deft by their attorneys aforesaid and the Jurors of that Jury therein Impannelled being called likewise Came to witt William Simpson, Samuel Taylor James Thompson, Teague Riggin Robert Collier, Peter frazer, John Harris George Benston, Daniel Maddox, Thomas Holbrook, Parker Selby, and W.m Holland who being duly Elected tryed and Sworn to say the truth in the premisses upon their Oath do say that the said Joseph Pemberton did assume upon himselfe in manner and form as the said Isaac Handy above against him hath Complained and do assess the damage of the Same Isaac by Occasion of the non performance of the promise and assumption aforesaid besides his Costs and Charges ^by him about his Suit in that part Expended^ to One thousand and thirty Six pounds of tobacco and for those Costs and Charges to one pound of tobacco Therefore it is Considered by the Court here that the aforesaid Isaac Handy Recover against the afd Joseph Pemberton his damages afd by the Jurors aforesaid in form afd assessed to one thousand and thirty seven pounds of tobacco as also five hundred and fifty three pounds of tobacco for his Costs and Charges to the same Isaac Handy by the Court hereof his assent of Increase adjudged which Certain Damages in the whole do amount to fifteen hundred and Ninty pounds of tobo and the aforesaid deft in mercy &a
Seven at somersett County within the Jurisdiction of this Court was Indebted unto the Same Riggin in the sum of five hundred pounds of tobacco for divers services for ^the said^ Elizabeth Standley by the said Elizabeth Riggin at her especiall Instance and request done and performed and for meat drink and Lodging for her by the said Riggin found as by account produced may appear and so thereof being Indebted the said Standley in Consideration thereof afterwards to witt the same day and year Last mentioned at the County aforesaid and within the aforesaid Jurisdiction upon herselfe assumed and to the Same Riggin then |
