162 And whereupon the afd William Hopkins being Called appears and thereupon the said William Hopkins at the prayer of the Plft is adjudged to give speciall bail to the action aforesaid whereupon a Certain Thomas Claywell of somersett County planter present here in Court undertakes for the said Hopkins that if in case the said James Martin shall recover Judgm.t in the plea aforesaid against the said William Hopkins or that the said William Hopkins shall be therein Convict that then he the said William Hopkins shall pay the Condemnation of the Court or render his body to the Custody of the sher of Somersett County in Satisfaction thereof or that he the said Thomas Claywell will do it for him Whereupon the said William Hopkins by francis Allen his attorney Comes and defends the force and Injury when &.c and says that he cannot gainsay the action aforesaid of the afd James nor but that he did assume upon himselfe in manner and form as the afd James above against him hath Complained and as to the damage of the same James by him Occasion of the premisses in that part Sustained the same William says and Confesseth that the aforesaid James has sustained damage by Occasion of the premisses aforesaid beyound his Costs and Charges by him about his Suite in that part Expended to ten pounds Eleven shillings Currt mony and because the aforesaid James denys not this but the same allegation Confesseth to be true prays Judgm.t and these damages above confessed together with his Costs and Charges to him adjudged &c Therefore by Consent of the Parties aforesaid it is Considered that the aforesaid James Martin recover against the aforesaid William Hopkins his damages aforesaid to ten pounds Eleven Shillings Curr.t mony by the same William in form afd Confessed as also two hundred & Ninty Three pounds of tobacco for his Costs and Charges to the Same James at his request by the Court here of by Consent of the parties afd adjudged which Certain damages in the whole do amount to Ten pounds Eleven shillings Curr.t mony and Two hundred and Ninty three pounds of tobacco and the aforesaid deft in mercy &c
Endorsed vizt Cepi Corpus P John Purnall sher Whereupon the said John Pepper being Called appears and thereupon the Said John Pepper at the prayer of the aforesaid Archibald Smith by francis Allen his attorney is adjudged to give speciall bail to the action afd but for want thereof he is Committed into the Custody of the sher of Somersett County thereto Remain &c Afterwards a Certain W.m Bishop of Somersett county planter present herein Court undertakes for the said John Pepper that if in Case the said Archibald Smith Shall Recover Judgm.t |
