Martin of a plea of trespass upon the Case &.a  And that thereof he Should not fail &.a  And the
afd James Martin in his own proper person declared against ye afd W.m Hopkins in the plea
afd as Followeth Vizt

      Somrsett fs   Will.m Hopkins Late of Somrsett Co.ty Planter was Attached to answer unto
                   James Martin of a plea of trespass upon the Case &a

    And Whereupon the Same James Martin in his own proper person Complains that whereas
ye afd W.m Hopkins the twentieth day of July Anno Dom one thousand Seven Hundred & twenty
Seven at Somrsett Co.ty within ye Jur of this Co.t was Indebted to ye Same James in ye Sum of thirteen
pd.s two Shills & Nine pence Curr.t Money of maryland as by Acc.t herewithin Court produced may
appear & so thereof being Indebted ye Said W.m in Consideration thereof afterwards to witt ye same
day & year afd at ye Co.ty afd & within ye afd Jur upon himselfe assumed & to the same Jam.s
then & there faithfully promised that he when afterwards he Should be thereto requested
he the afd Sum of thirteen pd.s two Shills & Nine pence Curr.t Mony to ye same Jam.s
wou'd well & faithfully Content & pay Nevertheless ye said Will.m his promise & assumption
afd in form afd made Not regarding but Plotting & fraudulently Intending him ye Same
James in yt part Craftilly & Subtilly to Defraud & Deceive the afd W.m the afd Sum of
thirteen pd.s two Shillings & Nine pence Curr.t mony or any part thereof to ye Same Jam.s
he hath not paid or him for it in any wise Contented altho' the Same to do ye afd Will.m
afterwards Viz.t the Same day & year afd at the Co.ty afd & within ye afd Jur by the same
James was requested but the SAme hitherto to do hath altogether refused & Still
Doth refuse Whereby the Same James Say's he is worse & hath Damage to the value
of twenty Six pd.s three Shill.s & Six pence Curr.t mony & thereof he Brings this Suite &.a

       Att which said third tuesday of March to witt the Eighteenth day of the same month ann.o Dom One
thousand Seven hundred and Twenty Eight being the day of the Return of the said writt Cometh the said James
Martin in his Own proper person and the Sher of Somersett County to whom the foregoeing writt was directed
Likewise Cometh and maketh return thereof Endorsed viz.t Cepi Corpus declaration delivered in time P Jno Purnall sher
