in the County afd Within the Jur of this Court one Gould Necklass and Lockett of ye Value
of Seven pounds Curr.t Money of Maryland of the proper Goods & Chattles of a Certain John
Donelson of the place afd then & there being and found then & there feloniously did take
Steall and Carry away Contrary ^to^ an act of assembly of this province and against the
Peace &.a                                                Dashiell prosecutor for his L:D: P.r
                   Testis   John Donelson                  On the Back side of the foregoing Bill
of Indictment it was thus Endorsed viz.t                      A true Bill Geo: Scott foreman

      Thereupon Command was given to the Sher of Somersett County that he Should take the
    said Mary Barwick if &.c to answer &.c and af^t^erwards in the Same Court Came the Said
    Mary Barwick under Custody of the Said Sher into whose Custody before that time was
    Committed for the Cause aforesaid and being by the Said sher brought to the barr and having
    heard the Indictment aforesaid she says that she is not Guilty of the felony afd as by the
    Indictm.t aforesaid is upon her Imposed   Whereupon the Court here values the afd Gold necklace
    and Lockett in the Indictment aforesaid mentioned to Nine hundred and Eighty pounds of tob.o

                   Therefore it is Considered by the Court that the said Mary Barwick pay unto the
    said John Donelson the party deprived four fould of the value of the Necklace and Lockett afd
    amounting in the whole to three thousand Nine hundred and Twenty pounds of tobacco and that
    the afd Mary Barwick be whipt with thirty nine lashes on the bear Back well Laid on untill
    the blood appear and that she stand in the pillowry one hour and that she be taken &.c and
    thereupon as to the Corporall punishment aforesaid Command is given to the sher of Somersett
    County that he do thereof Immediate Execution according to the Judgm.t aforesaid Rendered by
    whiping of the af Mary Barwick at the publick whiping post with thirty Nine Lashes on the
    bear Back well laid on untill the blood appear and by sitting her in the pillowry one hour
    afterwards in the Same Court the Sher returns that he has done the Execution of the Judgm.t
    aforesaid as to the Corporall Punishment afd he was Commanded   whereupon the said Jno Donelson
    master of the afd Mary Barwick present hereinto Court undertakes for to deliver up unto Somerset
    County Court or sher of Said County  At the Expiration of her servitude the afd Mary Barwick to
    Reemburst to ye said County the fees due by occasion of the felony afd &c


    John Donelson appears according to his recognizance Entered into to give Evidence against Mary Barwick and is
    is discharged

 Robert Scott appears according to his recognizance Entered into for his good behaviour
and appearance at this Court for to answer a breach of his Lordships Peace made by
him upon a Certain Acksah Lawrence and is discharged therefrom and is ordered
by the Court to Give New recognizance with One Security Each in ten pounds Ster for his good behaviour
