156 taken &.c whereupon it is ordered by the Court that the said Mary Patrick give Security for the fine afd and all the officers their fees due by means of the premisses afd thereupon a Certain Wm Porter of all hollows parish planter present here in Court undertakes for the Said Mary Patrick to pay the fine afd and the Severall officers their fees afd due by occasion of the premises &c Thereupon it is further Ordered by the Court that the said Mary Patrick give Recognizance in ten pounds Sterr for her go appearance at June Court next And give Evidence against a Certain Samuel Bratton son of John Bratton at Suite of his Lordship Whereupon the said Mary Patrick present here in Court acknowledged herselfe to Owe and Stand Justly Indebted unto his said Lordship the Lord proprietary in the Sum of ten pounds Sterling good and Lawfull mony of England to be Levied upon her goods goods and Chattells Lands or tenements for the Use of his said Lordship if default be made in the Condition hereunder written The Condition of this Recognizance is Such that if the above bounden Mary Patrick do make her personall appearance before the Justices of the next Court to be held at dividing Creek in the County afd the third tuesday of June next and then and there give Evidence on behalfe of his said Lordship agt the afd Samuel Bratton Concerning the begetting of a bastard Child and do not depart without Leave of the Court then the above Recognizance to be void and of none Effect otherwise &a
Thereupon Command was Given to the sher of Somersett County that he should take the said Thomas Holbrook if &.c to answer &.c And afterwards in the same Court Comes the afd Thomas Holbrook in his own proper person and prays leave untill next Court to answer the premisses afd and it is granted him and the same day is given unto George Dashiell his Lordships attorney (who for his said Lordship in this behalfe prosecutes) also Att which said next Court to witt the Eighteenth day of the March anno Dom one thousand Seven hundred and twenty EIght Came again as well the afd George Dashiell who for his Said Lordship in this behalfe prosecutes as the afd Thomas Holbrook in his own proper person and the said Thomas Holbrook being by the Sher sett to the bar is thereupon Instantly demanded how he would acquitt himselfe of the premisses afd says that of the premisses afd his is Guilty thereof and says that he is Innocent ^of the premisses^ thereof and Submitts himselfe to the mercy of the Court Wherefore it is Considered by the Court that the afd Thomas Holbrook be taken to Satisfie his said Lordship of his fine by Occasion of the premisses afd which same Tho.s Holbrook |
