1728 152 of a Commission to us Directed from Somrsett Co.ty Co.t the above Deposition was taken before us This Deposition was taken Ephraim Willson at the request of Edward Beauchamp Ephraim Willson Boaz Walston John Trehearn
Greetings Know ye that we have appointed you or any three or two of you to be our Commissioners to Examine Evidences on behalfe of a Certain Patience and John atkinson of ye Co.ty in relation to the Bounds of a tract of Land Lying in ye Said Co.ty Called America Wee therefore Require you or any three or two of you that at Some time & place as to you or any three or two of you Shall Seem Convenient you Mete on ye afd Land Called america (you first haveing taken your Oath on ye Holy Evangelist of almighty God according to act of assembly in Such Case made & Provided) and there Cause to Come before you or any three or to of you all Such Evidences as Shall be to you or any three or two of you Nominated by ye Said Complaniant (or Deft if any) & that you Examine them upon their Corporall Oaths to be by you or any three or two of you administred on ye Holy Evangelist of almighty God in ye presence of ye Complaniant (or Deft if any) touching the truth or remembrances of their Knowledge or any thing that may relate to ye Caus afd & that reduceing the Severall Depositions into Writing you Send the Same together with this our Commission under your or any three or two of your Hands to us to our Co.ty Co.t of Somrsett with all Convenient Speed Wittness Saml Hopkins Gen Chief Justice &a The Execution of the within Commission appears by the Severall Deposition's hereunto Annexed W.m Handy George Tull The Deposition of Edm.d Dickerson Sen.r aged Sixty three years or thereabouts being Sworn upon ye Holy Evangelist of almighty God before us the Subscribers on ye 14th day of Jenry 1728/9 Saith yt when Coll Will.m Whittington was Survayer of Somrsett Co.ty he Comeing to Survey Cornelias Morris Land Called affreca he ye Said Edm.d being Psent at ye Survey ye Said Coll Whittington Asked Joseph Gray where he Left of & the said Whittington bid me tell my father Morris yt if he would not Come & being there when M.r Gray Left of he would not Survey none for him Coll Whittington Desired this Deponant to goe in the Branch & see if y.t Sipruss tree was Marked which Sipruss did Stand in ye Branch near the Boeing our ^over^ from Mr Jos: Gray's to his son Tho.s Gray by a Foot Bridge which Bridge remains Still in the Same place & this Deponant went in the Branch & see the Said Sipruss Standing in ye place afd being Marked with Sixteen Notches on four sides & ye Said Coll Whittington Ordered ye Claim to be Carried to the Sipruss tree afd & Measure from ye tree afd to him and there Laid out for Cornelias Morris from yt tree three Hundred Acres of Land which Land ye S.d Jeremiah Morris (had) |
