151 Lord Proprietary that is to say the Said Patrick Malalley in one hundred pounds Sterr and the said Robert Collier and Geo: Benston in fifty pounds sterr Each on their goods and Chattells Lands and tenements seperately to be made and Levied for the Use of his said Lordship his heirs and Successors if default be made in the Condition hereunder written The Condition of the above Recognizance is such that if the above bound Patrick Malalley do and shall make his personall appearance before his said Lordship's Justices of assize nisi prius oyer and terminer and Goal deliver at dividing Creek ^in the County afd^ the first tuesday of aprill next then and there to answer unto all such matters and things as on his said Lordship's behalfe shall be Objected against him and do stand and abide the Judgm.t of the Court thereon and do not depart the Same Court without Lycence thereof and in the mean time to be of the good behaviour and well and up rightly behave himselfe towards his said Lordship and all his good People then this Recognizance to be void and of none Effect otherwise to be and remain in full force and vertue in law &c
Examine Evidences on Behalfe of a Certain Daniel Hull of the Co.ty afd in relation to the Bounds of a tract of Land Lying in the Co.ty afd Called Long Ridge Wee Therefore require you or any three or two of you at Some time & Place as to you or any three or two of you Shall Seem Convenient you Meet on ye afd Land Called Long Ridge (you first haveing taken your Oaths on the Holy Evangelist of almighty God According to act of assembly in Such Case made & Provided) & there Cause to Come before you or any three or two of you all Such Evidences as Shall be to you or any three or two of you Nominated by ye Said Complaniant (or Deft if any) & y.t you Examine them upon there Corporall Oaths to be by you or any three or two of you administred on ye Holy Evangelist of almighty God in ye presents of ye Complaniant (or Deft if any) touching ye truth or remembranceces of there knowledge or any thing that may relate to ye Cause afd & yt reduceing the Several Depositions into Writing you Send ye Same together with this our Commission under your or any three or two of your hands to us to our Co.ty Co.t of Somrsett with all Convenient Speed Wittness Saml Hopkins Gent Chief Justice &a The Deposition of John Tilman aged thirty Eight years being Sworn on ye Holy Evangelist of almighty God Sayeth that about Nine years agoe he Saw a marked white Oake Standing nigh ye dam side much about ye place where William Catlin gave his Deposition of a marked white Oake & further Saith not Taken this Second day of September 1728: By vertue of a Commission to us Directed from Somrsett County Court the above Deposition was taken before us this Deposition was taken at ye request of Daniel Hull Ephraim Wilson Boaz Walston John Trehearn |
