149 Att which said next Court to witt the Ninteenth day of Novem.r Anno Dom One thousand seven hundred and twenty Eight Came again as well the afd Charles Markland by his attorney afd as the afd Jno Hendry and the sher into whose Custody was Committed the afd John Hendry for the Caus afd Returns a Certain Bail peice according to an act of assembly in Such Case made and provided which follows in these words vizt Charles Markland Plft against John Hendry deft You Parker Selby and John Scarbrough and Either of you do undertake for the Said John Hendry deft in forty four pounds Curr.t mony to be Levied on your and Either of your Lands and tenements Goods or Chattells to the Use of the Said Charles Markland plft upon Condition that if the said Charles Markland do obtain Judgm.t in an action of trespass upon the Case depending in the County Court of Somersett against the said John Hendry deft that then the said John Hendry shall pay the Condemnation of the Court thereupon or deliver himselfe to the Custody of the sher of Somersett County in Satisfaction thereof or you or one of you will do it for him they acknowledge themselves to be Content therewith this 24th day of Sep.t anno 1728 Wittness To the Worshipfull the Justices of the County Court Saml Hopkins Whereupon the said John Hendry in his proper person Comes and defends the force and Injury when &c and Says that he Cannot Gainsay the plft his action afd against him brought nor Can he say but that he did assume upon himselfe as the afd Plft above against him hath Complained nor Can he say but that the said Charles ought to recover his damages by occasion of the premises afd to twenty pounds fifteen shillings and five pence Currt mony and Costs of Suit against him which ye Said Plft doth not Gainsay &c Therefore it is Considered that the afd Charles Markland Recover against the afd John Hendry twenty pounds fifteen shillings and five pence Currant mony his damages by the Same John in form afd Confesed as also four hundred and seven pounds of tobo 407 for his Costs and Charges to the same Charles at his request by the Court here of his assent adjudged and the afd deft in mercy &.a To Levin Gale one of the attorneys of Somersett County Court I do hereby appoint you my attorney in my Name to prosecute all actions that shall be brought in the Court afd Either by or against me as wittness my hand and seal this 22d of Novem 1728 Jn.o Tunstall Wittness Jno Scott The Court adjourns till the third tuesday of March Ann.o 1728 |
