149 time by the same Charles sold and delivered and so thereof being Indebted the same John in Consideration thereof afterwards to witt the Same day and Year afd at the County afd and within the afd Jurisdiction afd upon himselfe assumed and to the said Charles Markland then and there faithfully promised that he when afterwards he should be thereunto Requested he the Said Sum of twenty pounds fifteen shillings and five pence Curr.t mony to the said Charles would well and faithfully Content and pay nevertheless the said John his promise and assumption afd in form afd made Little Regarding but plotting and fraudulently Intending him the said Charles Craftilly and Subtilly to deceive and defraud he the afd Sum of Twenty pounds fifteen shillings and five pence Curr mony or any part thereof to the same Charles hath not paid or him for it in any wise Contented altho' the said John the same to do afterwards viz.t the Same day and Year afd at the County afd and within the afd Jurisdiction was thereunto by the said Charles Requested but he the Same to doe hath altogether refused and still doth refuse whereby the said Charles says he is worse and hath damage to the value of thirty five pounds Curr.t mony and thereof he brings this Suite &c L Gale P Qrte Pledgs &.c J Doe R Roe And the afd John Hendry in his Own proper person appears and thereupon the said John Hendry at the prayer of the plfts ^attorney^ afd is adjudged to Give speciall bail to the action afd thereupon a Certain Samuel Derickson of the County afd planter present herein Court undertakes for the said John Hendry that if in Case the said Charles Markland shall recover Judgm.t in the plea afd against the said John Henry or that the Said John Henry shall be therein Convict that then he the said John Hendry shall pay the Condemnation of the Court thereupon or render his body to the Custody of the sherr of somersett County in Satisfaction thereof or that he the Said Samuel Derickson will do it for him &c Thereupon the said John Hendry in his Own proper person Comes and defends the force and Injury when &.c and prays Leave to Imparle hereunto untill the next Court and he hath it & the same is given to the afd plft here also Att which said Next Court to witt the twentieth day of August Anno Dom One thousand Seven hundred and twenty Eight Came again as well the afd Charles Markland by his attorney afd as the afd John Hendry in his Own proper person and whereupon Came the afd Samuel Derickson hereinto Court and prays that he may be discharged from being bail for the afd John Hendry afd which is unto him Granted, Thereupon the afd Charles Markland by by his attorney afd prays that the said John Hendry may be adjudged to Give Speciall bail to the action afd but for want thereof the afd John Hendry is Committed into the Custody of the sher of Somersett County there to remain &c thereupon the said sher to witt John Purnall of Somersett County Gent Present herein Court takes Charge of the said John ^Hendry^ accordingly &c thereupon day is given to the afd John Hendry in Custody untill the Next Court to answer unto the afd Charles Markland in the plea afd and the same day is given to the plft ^here^ also at |
