144 Content and pay Nevertheless the said Isaac his promise and assumption afd in form afd made not Regarding but plotting and fraudulently Intending him the Same Robert in that part Craftily and Subtilly to defraude and Deceive the afd Isaac the said Sum of one pounds seventeen shillings and Six pence or any part thereof to the same Robert he hath not paid altho the same to doe the afd Isaac afterwards vizt the same day and year afd and within the afd Jurisdiction by the same Robert was Requested but he the Same hitherto to doe hath altogether Refused and Still doth Refuse whereby the Same Robert says he is worse and hath damage to the value of three pounds Curr.t mony and thereof he brings this suite &.c L Gale pledge &c Jno Do R Roe And the afd Isaac Coston in his Own proper person Comes and defends the force and Injury when &.c and says that he Cannot deny the action afd of the afd Robert nor but that he did assume upon himselfe in manner and form as the afd Robert above against him hath Complained and as to the damages of the same Robert by Occasion of the premisses in that part Sustained the Same Isaac Says and Confesseth that the afd Robert sustained by damage Occasion of the premises besides his Costs and Charges by him about his Suit in that part Expended to One pound Seventeen shillings and Six pence Currant mony and noe more and because the afd Robert denys not this but the same allegation Confesseth prays Judgmt and his damages above Confessed together with his Costs and Charges afd to him adjudged &c Therefore by Consent of the Parties afd it is Considered that the afd Robert Boyer recover against the afd Isaac Costan his damage afd to one pound Seventeen shillings and six pence Curr.t mony afd by the same Isaac in form afd Confessed as also two hundred & ten pounds of tobacco for his Costs and Charges afd to the same Robert at his request by the Court here and Consent of the parties afd adjudged which damage in the whole to amount to one pound seventeen shillings & Six pence Curr.t mony & two hundred & ten pounds of tobo and the afd Isaac in Mercy &c
Levin Gale his attorney Complaines that whereas the afd Nathaniell the fifteenth day of December ann.o Dom One thousand seven hundred and twenty Seven at somersett County within the Jurisdiction of this Court was Indebted to the same Archibald in the Sum of Six pounds Seven Shillings & two pence farthing Currt Mony of maryland for divers goods wares and Merchandizes before that time at his Especiall Instance and Request sold and delivered and so thereof being Indebted the said Nathaniel in Consideration thereof afterwards to wit the same day and year afd at the County afd and within the afd Jurisdiction upon himselfe assumed & To the same Archibald then and there faithfully Promissed that he when afterwards he should be thereto Requested he the afd Sum of Six pounds Seven shill.s and two Pence one farthing Currt Mony to the Same Archibald wou'd well and faithfully Content and Pay Nevertheless the said Nathaniel his Promise and assumption afd in form afd made not Reguarding but Plotting and fraudulently Intending him the same Archibald in that part Craftilly and Subtilly to defraud and deceive the afd Six pounds ^seven^ Shill.s and two pence one farthing or any part thereof to the same Archibald he hath not paid altho' the same to doe the afd Nathaniel afterwards viz.t the same day and Year afd at the County afd and within the afd Jurisdiction by the same Archibald was Requested but |
