Archibald says he is worse and hath damage to the value of twelve pounds fourteen shillings & four pence

    And the afd Nathaniel Holliston by francis Allen his attorney Comes and defends the force &
Injury when &.c and prays Leave to Imparle hereunto untill the next Court and he hath it &
the same day is given to the afd Plft here also

                Att which said next Court to witt the Nineteenth day of Novem Anno Dom one thousand
Seven hundred and twenty Eight Came again as well the afd Archibald as the afd Nathaniell by
their attorneys afd and the afd and thereupon y.e afd Nathaniel by his said attorney says that
he Cannot gain say the Action afd of the afd Archibald nor but that he did assume upon himselfe in manner
and form as the afd Archibald above against him hath Complaines and as to the damage of the same
Archibald by Occasion of the Premisses in that part Sustained and the Same Nathaniel saith
and Confesseth that the afd Archibald sustained damage by occasion of the premisses besides his
Costs and Charges by him about his suite in that part Expended to six pounds Seven Shillings &
two pence one farthing Curr.t mony of maryland and because the afd Archibald this not denyes but
the same allegation in Every word Confesseth prays Judgment and his damages above Confessed
together with his Costs and Charges afd to him adjudged &c

                       Therefore by is Consent of the Party's afd it is Considered that the afd Archibald Smith
Recover against the afd Nathaniel Holliston his damages afd to Six pound Seven Shill.s & two pence
one farthing Currant mony of maryland by the same Nathaniel in form afd Confessed as also two
hundred and twenty four pounds of tobacco for his Costs and Charges afd to the same Archibald at
his request by the Court here of by assent of the partys afd adjudged which Certain damages in
the whole do amount to six pound seven shill.s & two pence one farthing Currt Mony & two hundred
and twenty four pounds of tobacco with stay of Execution till the Last day of march next  And
the afd Nathaniel in Mercy &c
