143 Att which said Next Court to witt the twentieth day of August ann.o Dom one thousand Seven hundred and twenty Eight Came againe as well the afd Adam Muir as the afd Eliz.a Dashiell by their attorneys afd And whereupon the dispute in this action is by the Consent of the partyes by their afd attorneys Refered to John Handy and James MccMorie of Somersett County Gentlemen according to the Statute and Judgm.t to be given on their return as of this Court and day is given to the afd Partyes here untill Next Court to hear thereof their Judgmt of & upon the premises afd &.c Att which said next Court to witt the Ninteenth day of November anno Dom one thousand Seven hundred and twenty Eight Came againe as well the afd Adam Muir as the afd Eliz.a Dashiell by their attorneys afd and Likewise came here the afd John Handy and James MccMorie and Make return to the Court their award in the premisses afd as followeth viz.t by vertue of a Commission to us directed bearing date the 23.d day of August 1728 out of the Court of Somersett County to auditt accounts Between Adam Muir Plft and Elizabeth Dashiell deft and having taken upon us the burthen thereof and hearing the allegations of both parties Examineing the accounts and hearing the Evidences on both sides to us produced do award that Eliz.a Dashiell pay the said Muir the quantity of Six thousand merchantable Pipe Staves at fifty five shill.s p Thousand and the remainder of his account in Corn and Porke at Country Price the Ballance of said Muir's account being twenty Eight pounds one shilling and three pence three farthings as wittness our hands and Seales this 26th day of September anno Dom 1728 John Handy's (seal) James Makmorie (seal) Which being read and heard &.c Therefore it is Considered that the afd Adam Muir Recover against the afd Eliz.a Dashiell admrx as afd the Sum of twenty Eight pounds One shilling and three pence three farthings (to be paid as followeth six thousand Merchantable Pipe Staves at fifty five shilling p thousand and the remainder of the afd twenty Eight pounds one shilling and three pence three farthings to be paid in Corn and Porke at Country price) his Damages afd by occasion of the premises as also four hundred and thirty Nine pounds of tobacco for his Costs and Charges to the Same Adam at his request by the Court here of his assent adjudged of the goods and Chattells which were of the afd Christopher Dashiell at the time of his death in the hands of the same Eliz.a to be administred if so much in her hands she hath and if so much in her hands she hath not then the Costs afd of the proper goods and Chattells of the afd Eliz.a to be Levied and the afd deft in mercy &c
of a plea that he render unto ^him^ Twenty pounds Currant mony of america according to an act of parliament made in the sixth Year of her late Majesties Reign for the assertaining the rates of forreign Coines in the plantations which to him he Owes and from him he unjustly detaines &c And whereupon the same John Hobard by George Dashiell his attorney Complains that whereas the afd Benjamin sharp the twenty sixth day of June anno Dom One thousand Seven hundred and twenty Seven at somersett County within the Jurisdiction of this Court by his Certain writing Obligatory Granted himselfe held and firmly bound unto the same John in the sum of twenty pounds Currant Lawfull money of america to be paid the Same John when afterwards the |
