Instigation of the devill on or about the second day of february Ann.o Dom One thousand Seven hundred and twenty seven eight at somersett County afd within the Jurisdiction of this Court did Committ adultery with a Certain Hannah Noble of the Same parish and on her body did begett a male bastard Child to the great dishonour of Almighty God against the peace of the right honourable the Lord proprietary his good rule and Government and against the form of an act of assembly of this province in such Case made and Provided &c Dashiell prosecuter for his LDp Testis: Hannah Noble On the back side of the foregoeing bill of Indictm.t it was thus Endorsed vizt A True Bill William Lane foreman Thereupon Command was given to the sher of Somersett County that he Should take the afd George Benston if &.c to answer &c Afterwards here in Court Came the afd George Benston in his proper person and being by the sher sett to the bar (Indictment read) is thereupon Instantly demanded how he would acquitt himselfe of the premises afd above upon his Imposed says that of the premisses afd as by the Indictment above upon him Imposed he is noeways guilty thereof and thereof for tryall puts himselfe upon the Country and George Dashiell who for his said Lordship in this behalfe prosecutes Likewise Thereupon Command is given to the sher of Somersett County that Immediately he Cause to Come here twelve &.c who &.c to recognize &.c because as well &.c of which said preceipt the Said sher to witt John Purnall ^Gent^ makes return that he hath here ready twelve &.c as by his said preceipt he was Commanded and the Jurors of that Jury therein Impannelled being Called Came to witt Adam Hitch, William Jones, Ceaser Goddin Thomas Collins, Peter Claywell, Johnson Hill, William Cord, Edmond Hought Thomas Holbrook, Charles Townsend, Brufe Broughton, Peter frazer who being duly tryed and Sworn to Say the truth in the premisses upon their Oath do say that the afd George Benston is Guilty of the adultery whereof he stands Indicted &c Wherefore it is Considered that the afd George Benston be fined to his Lordship the Lord proprietary three pounds Curr.t mony for the fact afd toward the defraying of the County and that she be he be taken &.c whereupon the said George Benston is discharged paying the fees due by Occasion of the premisses afd &.c Whereupon it is ordered by the Court that the afd George Benston take Care of the Child afd begott of the afd Hannah Noble he ind present here in Court promiseth so to do &a |
