139 Steal and Carry away against the Peace of the Right honrble the Lord proprietary his good rule and Government and against the form of an act of assembly of this province in Such Cases made and provided Testes John Macomb &c W.m Jones Dashiell prosecutor for Ld Py On the Back side of the foregoeing Bill of Indictm.t it was thus Endorsed viz.t Billa vera Whereupon all and Singular the premisses by the Justices here being seen heard and full understood & mature deliberation thereupon had it seemeth to the Justices here that the Indictmt afd and the Endorsm.t thereof are Insufficient &.c Wherefore it is Considered by the Justices here that the RIght honrble the the Lord Proprietary take nothing by the Indictm.t afd but that the afd Mary Peirce be thereof quiet quiett wherefore it is ordered by the Court here that the afd Mary Peirce give security to pay the Severall Officers their fees due by Occasion of the premisses afd thereupon Levin Gale of Somersett County Gentl present here in Court undertakes for to pay the Severall officers their fees due by means of the prem premisses afd &c Mr Jno Caldwell appears according to his recognizance and is discharged there from &c Jno Macomb appears according to his Recognizance Entered into and is discharged there from &c Thomas Langford appears according to his Recognizance Entered into and is discharged there from &c Hugh Stewart and Robt Scott appears according to their Recognizance Entered into & are discharged &.c
Thereupon Command was given to the Sherr of Somersett County that he should take the afd Hannah Noble if &.c to answer &.c Afterwards in the Same Court Came the afd Hannah Noble in her Own proper person Came and being by the Sherr sett to the bar is thereupon Instantly demanded how she would acquitt herselfe of the premises afd says that of the premisses afd above upon her Imposeds she is Guilty thereof and prays that she may be admitted to make fine to the Lord proprietary for the Same &.c Wherefore it is Considered by the Justices here that the afd Hannah Noble be fined to his said Lordship for the fact afd thirty shillings for the fact towards the defraying of the County Charge and that she be taken &.c Whereupon it is Ordered by the Court that the afd Hannah Noble give security for the payment of the Severall Officers their fees &.c Thereupon a Certain Geo: Tull of Somersett County Gentl present here in Court under takes to pay the severall officers their fees due by occasion of their fees &c William Benston appears according to his Recognizance Entered into for his good behaviour and accordingly discharged &c Ordered by the Court here that a Certain Robert Cift be discharged from Recognizance for the good behaviour &c |
