the Same to doe ye afd Richard afterwards viz.t the same day & year afd at ye Coty
afd & within ye afd Jur by the Same Moses was requested but he the same
hitherto to doe hath altogether refused & Stl Still doth refuse whereby the

the force & Injury when &.a  And pray's Leave to Imparle hereunto untill
the Next Court & he hath it & the same day is given to ye afd Plft here
also &a      Att which said Next Court to witt the twentieth day of August anno
Dom one thousand Seven Hundred & twenty Eight Came again as well ye afd
Moses Chaille as ye by his attry afd as the afd Richard Driskill in his own proper
person & the afd Richard Driskill in his own proper person as before Defends
the force & Injury when &a   And Saith that he Cannot gain say the action
afd of the afd Moses Chaille nor but that he did assume upon himselfe in
Manner & form as ye afd Moses Chaille above against him hath Complained &
as to the Dam.s of the Same Moses Chaille by him by Occasion of the premisses
in that part Sustained the Same Richard Driskill Saith & Confesseth yt ye afd
Moses Chaille Hath Sustained Dam by ye Occasion of ye Premisses besides
his Costs & Charges by him about his Suite in that part Expended to two pds & six
pence Curr.t mony & because ye af Moses Chaille deny's not this but prays Judgment
& the Same Dam above Confessed together with his Costs & Charges afd to him
adjudged &a            Therefore by Consent of ye Party's afd it is Considered yt ye afd
Moses Chaille recover against the afd Rich.d Driskill his Dam.s afd to two pd.s &
Six pence Curr.t Mony by the Same Richd Driskill in form afd Confessed as also
two hundred and Eighty Six pounds of tobacco      for his Costs & Charges afd to the same
Moses Chaille at his request by the Court hereby ye assent of of the Parties
