    August Court                       1728                 130

Creek ^afd^ were adjudged for his damages which he had by Occasion of a Certain Promise and assumption
to the Same ^Jno^ Rider by the afd John Esome Lately made and not Performed whereof he was Convict
and that thereof he should not fail &.c

                                        Att which said third tuesday of August to witt the Twentieth day of the
same month Anno Dom One thousand Seven hundred and twenty Eight being the day of the Return
of the Said Writt Cometh the afd John Rider by Levin Gale his attorney afd and the Sherr of Somersett
County Likewise Comes and makes Return that of the foregoeing writt thereof Endorsed in these
words following vizt
                                                          Cepi Corpus P fran Allen sher

                      And whereupon the afd John Esome being Present herein Court in the Custody of the
sher  And thereupon the afd John Esome at the prayer of the afd John Rider by his attorney afd is by
the Court Committed into the Custody of the afd Sher there to Remain untill the afd John Rider of
his damages afd be fully Satisfied &.c  
                                                             Whereupon the afd sher being Present here in Court took
Charge of the afd Jn.o Esome accordingly &c

of Somrsett Co.ty  Greeting we Command you that of ye
Goods & Chattles which were of Tho.s Willdgoose Late of
the Co.ty afd dec.d in the Hands of Mary Woodcraft Exrx of the last will & testam.t
of the Same Tho.s Wildgoose being in your Balywick you make as well a Certain
Debt of Seven pd.s Nine Shill.s & Nine pence Lawfull mony of america which
Archibald Smith in our Co.ty Court of Somrsett before our Justices at Dividing
Creek Recovered against Her as three Hundred & twelve pd.s of Tob.o which to ye same
Archibald in our Same Court were adjudged for his Damages which he had by
Occasion of the Detaining of the Same Debt to be Levied of the goods & Chattles
which were of the afd Tho.s Wildgoose at ye time of his death & which to ye
hands of ye afd Mary Should thereafter happen to Come to be administred and
when you have the Same so made or any part thereof the same in your
Custody safe Keep so that you have the Same before our Justices of our
Co.ty Court of Somrsett to be held at Dividing Creek ye third tuesday of August
Nextto Satisfie the afd Archibald of the Debt & Damages afd whereof she is
Convict & have you then & there this Writt Wittness &a

          Att which said third tuesday of August to witt ye twentieth day of ye Same
Month Ann.o Dom one thousand Seven Hundred & twenty Eight Cometh the afd
Archibald Smith by Levin Gale his attry afd & the sher of Somrsett County to
Whome the foregoeing Writt was Directed Likewise Comes & Makes return thereof to
the Court here Endorsed in these words following vizt   By virtue of the within Writt to
me directed I went to ye within Named Mary Woodcraft who refused to shew me any Goods
Goods or Chattles of ye dec.d within Named in her Hands & further alledged that she Had
not now nor at anytime had any ^such^ Goods & Chattles so yt ye Same if any are by her Sold & Kept out
of Sight so as I can find none within my Balywick whereon to levy the Debt & Cost within Mentioned
so answers
