And the afd William Hopkins by George Dashiell his attorney Comes and defends the force
and Injury when &.c and prays Leave to Imparle hereunto untill the Next Court and he hath
it and the same day is given to the afd Plft here also &c

       Att which said next Court to witt the Eighteenth day of June Anno Dom one thousand Seven
hundred and twenty Seven Came again as well the afd Theodorus Bere as the afd W.m Hopkins
by their attorneys afd and the afd William Hopkins by his said attorney as before defends the
force and Injury when &c   and saith that he Cannot gainsay the Action afd of the afd Theod.r
Bere nor but that he did assume upon himselfe in manner and form as the afd Theod.r Bere
above against him hath Complained and as to the damage of the same Theodorus Bere by him
by Occasion of the Premisses in that part Sustained the same W.m Hopkins Saith and
Confesseth that the afd Theod.r Bere hath Sustained Damage by occasion of ye Premisses
besides his Costs and Charges by him about his Suite in that Part Expended to four hundred &
thirty pounds & one quarter of tobacco and because the afd Theod.r Bere deny's not this but
prays Judgm.t and the same Damages above Confessed together with his Costs & charges afd
to him adjudged &c

             Therefore by Consent of the Party's afd it is Considered that the afd Theod.r Bere
Recover against the afd W.m Hopkins his damages to four hundred and thirty pounds & one
quarter of tob.o by the Same W.m Hopkins in form afd Confessed as also two hundred and sixty
pounds of tobacco      for his Costs and Charges afd to the same Theod.r Bere at his Request
by the Court hereof The assent of the Parties afd adjudged which Certain damages in the
whole do amount to six hundred and Ninty ^pounds^ and one quarter of tobacco

                                                 and the afd Deft in Mercy &c

the afd Christopher in his Lifetime the Second Day of September One thousand seven
Hundred and twenty Six at Somrsett Co.ty afd within the Jur of this Court was
