And afterwards the afd Marg.t Price being Present herein Court in her proper person and whereas a Certain
Merrick Ellis who became Speciall bail for the said Marg.t Price in the action afd the said Merrick Ellis
likewise present here in Court delivers up the Said Marg.t Price to the Court of his Own Endemitie and
prays that he may be discharged from the Same      Thereupon the afd Marg.t Price is againe Committed
into the Custody of the Sherr of Somersett County thereto Remain untill the afd George Cooke of his damages
afd be fully Satisfied the Said Sherr to witt Jn.o Purnall Gent.m Present here in Court took Charge of
the Said Marg.tt Price accordingly &c

                          William Hopkins Late of Somersett County Planter was attached
to Answer unto Theod.r Bere of a Plea of Trespass upon the Case &c
And whereupon the Same Theodorus Bere by Levin Gale his attorney
Complains that whereas the afd Will.m Hopkins the tenth day of Novem Ann Dom one thousand
Seven hundred and twenty Seven at Somersett within the Jurisdiction of this Court was Indebted
to the same Theod.r in the Sum of four hundred and thirty pounds and one Quarter of tob.o for
divers goods wares and Merchandizes to him at his Especiall Instance before that time Sold and delivered
as by Acc.o herewithin Court produced may appear and so thereof being Indebted ye Said Will.m
in Consideration thereof afterwards to witt the Same day and Year afd at the county afd and within
the afd Jurisdiction upon himselfe assumed and to the Same Theod.r then and there faithfully promised
that he when afterwards he Should be thereto Requested he the afd Sum of four hundred &
thirty pounds and one quarter of tobacco to the Same Theod.r would well and faithfully Content
and Pay Nevertheless the said Will.m his Promise and assumption afd in form afd made not regarding
but Plotting and fraudulently Intending him the Same Theodor in that Part Craftilly and
Subtilly to defraud and deceive the afd William the afd Sum of four hundred and thirty pounds
and One Quarter of tobacco or any part thereof to the Same Theod.r he hath not Paid or him for
it in any wise Contented altho' the Same to do the afd W.m afterwards viz.t the Same day and year
afd at the County afd and within the afd Jurisdiction by the Same Theod.r was requested but he the
Same hitherto to do hath altogether Refused and Still Doth Refuse whereby the Same Theod.r says
he is worse and hath damage to the value of One thousand pounds of tob.o & thereof he Brings this
