1728 126 Assumption afd in form afd made not regarding but Plotting & fraudulently Intending him the Same Geo: in that Part Craftilly & Subtilly to Defraud & Deceive the afd Marg.tt the afd Sum of Sixteen Hundred pounds of Tob.o or any part thereof to the same Geo: she Hath Not paid although the Same to Doe the afd Margrett afterwards viz.t the Same Day & Year afd at the Co.ty afd & within the afd Jur by the same George was requested but she the same Hitherto to Doe Hath Altogether refused And Still doth refuse Whereby the same George Sayes he is worse & hath Dam to the Value of three Thousand pd.s of Tob.o & thereof he Brings this Suite &a L Gale P Quer Pledges &.a Jno Doe Richd Roe
And the afd Margrett Price by Geo: Dashiell her attry Comes & Defends the force & Injury When &.a and Prayes Leave to Imparle hereunto untill the Next Court & She Hath it & the Same Day is Given to the afd Plft here also &a Att which said next Court to witt the Twentieth day of August Ann.o Dom One thousand Seven hundred and twenty Eight Came againe as well the afd George Cooke as the afd Margt Price by their attorneys afd and the said Marg.t Price by her said attorney as before defends the force and Injury when &.a and saith that she did not assume in manner and form as the Plft against her hath Complained and of this she puts herselfe upon the Country and the Plft in like manner Thereupon Command is given to the sherr of Somersett County that Immediately he Cause to Come here twelve &.c by whom &.c who neither &.c to recognize &.c becaus as well &.c of which said Preceipt the said sher to witt John Purnall Gent.m Now hereat to witt the same day and year Last mentioned Comes and makes Return that he has here Ready twelve &.a as by his said Preceipt he was Commanded and Now hereafterwards to witt the same day and year Came as well the afd Plft as the afd deft by their attorneys afd and the Jurors of that Jury therein Impannelled being Called Came to witt Thomas Gillis, Lewis Disharoon, Jn.o Townsend Jun.r Jno White ye Parish Pocomoke Thomas Humphry's Jn.o fleming, Jn.o Shockley, Jn.o Broughton, Johnson Hill James Rownd, Stephen Walton, and John Roach who being duely Elected tryed and Sworn to Say the truth in the premisses upon their Oath do say that the afd Marg.t Price did assume upon herselfe in Manner and form as the afd George Cook above against her hath Complained and do assess the Damages of the afd George Cooke by Occasion of the Premisses besides his Costs and Charges to sixteen hundred pounds of tobacco and five shill Curr.t mony and for those Costs and Charges to One pound of tobacco Therefore it is Considered that the afd George Cook Recover against the afd Margt Price Sixteen hundred pounds of tobacco and five shillings Curr.t mony his damages afd in form afd by the Jurors assessed as also Nine hundred and Eleven Twelve pounds of tobacco at his request for for his Costs and Charges by the Court hereof Increase adjudged which Certain Damages in the whole do amount to two thousand five hundred & Twelve pounds of tobo and five shill Cur mony and the afd deft in Mercy Memorand.m the plft releaseth the five shill above being part of the Damages |
