125 And the afd James Parrimore by George Dashiell his attorney Comes and defends the force and Injury when &.c and Prays Leave to Imparle hereunto untill the Next Court and he hath it and the same day is given to the afd Plft here also &c Att which ^said^ next Court to witt the Eighteenth day of June Anno Dom One thousand Seven hundred & twenty Eight Came again as well the afd Adam Muir as the afd richd James Parrimore by their attorneys afd And the afd James Parrimore by his said attorney thereupon Prayed further Leave to Imparle hereunto untill the next Court and he hath it and the Same day is given to the afd Adam Muir here also &.c Att which said next Court to witt the twentieth day of August Anno Dom one thousand Seven hundred and twenty Eight Came again as well the afd Adam Muir as the afd James Parrimore by their attorneys afd and the afd James Parrimore by his said attorney as befor defends the force & Injurd when &.c and saith that he Cannot gainsay the action afd of the afd Adam Muir nor but that he did assume upon himselfe in Manner and form as the afd above against him hath Complained and as to the Damage of the Same Adam Muir by him by occasion of the premisses in that Part Sustained Damage by Occasion of the Premisses besides his Costs and Charges by him about his Suite in that Part Expended to Seven Pounds Eight shillings Currt Mony and No More and because the afd Adam Muir Deny's not this but Prays Judgmt and the same Damages above Confessed together with his Costs and Charges afd to him adjudged &.c Therefore by Consent of the Party's afd it is Considered that the afd Adam Muir Recover against the afd James Parrimore his damages to Seven Pounds Eight shillings Currt Mony by the Same James Parrimore in form afd Confessed as also two hundred and Ninty Nine pounds of tobacco for his Costs and Charges afd to the same Adam Muir at his Request by the Court hereof ^and by^ the assent of the Partie's afd adjudged which Certain damages in the whole do amount to Seven pound Eight Shill.s Currt Mony & two hundred and Ninety Nine pounds of tobacco and the afd Deft in Mercy &c
Co.t was Indebted to the Same George in the Sum of Sixteen Hundred pounds of Tob.o to the Likesum paid before that time at her request for her use paid as by acc.t in Court Produced may appear & so thereof being Indebted the Said Margrett in Consideration thereof afterwards to Witt the Same Day & Year afd at the County afd & within the afd Jur upon himselfe assumed & to the Same George then & there faithfully Promissed that ^she^ he when afterwards she shou'd be thereto requested she the afd sum of Sixteen Hundred p.ds of tob.o to the same George Would well and faithfully Content & pay Nevertheless the Said Margrett Her Promise and (assumption) |
