                   Whereupon the afd Hannah Burke Executrix as afd in her Own Proper person Comes
and defends the force and Injury when &c and Says that she Cannot gainsay the Plft his action afd
so as afd against her brought up nor Can she say but that the afd Tobias in his Life time did assume
upon himselfe in manner and form as the afd Plft above against him hath Complained nor Can
she say but that the Said Plft Ought to recover his damages by occasion of the Non performance
of the Promise and assumption afd to two thousand Nine hundred and forty Six pounds of
tobacco and One pound Nineteen shillings and Nine pence Curr.t mony which the said Plft doth
not gainsay
                                    Therefore it is Considered by the Court here that the afd Thomas Dashiell
Recover against the afd Hannah Burke Executrix of the afd Tobias Burke dec.d two thousand
Nine hundred and forty Six pounds of tobacco and one pound Ninteen shillings and Nine pence
329    Curr.t mony his damages afd in form afd Confessed as also three hundred & Twenty Nine
pounds of tobacco for his Costs and Charges by him about his suite in that part Expended to the same
Thomas by the Court hereof his assent adjudged of the goods and Chattells ^which were^ of the afd Tobias at the time
of his death Remaining in the hands of the afd Hannah to be administred if so much in her hands she
hath and if so much in her hands she hath not then the Costs afd to be Levied of the proper goods
and Chattells of the afd Hannah and the afd Deft in Mercy &c
